PROPOSED FINDINGS OF FACT <br /> MR. STANLEY MORTON <br /> <br />I. That Hr. Stanley Horton, hereinafter referred to as "Applicant", has <br /> properly applled for a condltlonal use permit to have an advertising <br /> sign. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission <br /> for a public hearing pursuant to Sections 170.013D and 170.05 of the <br /> City Code on November 1, 1988 and that said public hearing was properly <br /> advertised and that the minutes of said public hearing are hereby <br /> incorporated as part of these findings by reference. <br /> <br />3. That the subject property is generally known as 16355 St. Francis Blvd. <br /> N.W. and is legally described as follows: <br /> That part of the north half of the northeast quarter of Section 14, <br /> Township 32, Range 25, Anoka County, Minnesota described as follows: <br /> Commencing at the intersection of the north llne of said Section 14 <br /> with the center line of State Trunk Highway No. &7 as the same is now <br /> laid out and traveled, said point being 762.3 feet east from the north <br /> quarter corner of said Section 14, then south 3 degrees 05 minutes <br /> east along the center line of said highway a distance of 420 feet, <br /> then south 89 degrees 52 minutes east a distance of 894.39 feet, then <br /> north 0 degrees 19 minutes east a distance of 419.74 feet, then north <br /> 89 degrees 52 minutes west a distance of 910.40 feet to the actual <br /> point of beginning (except the west 313 feet thereof as measured along <br /> the north and south lines thereof) for the purpose of this <br /> description, the north line of said Section 14 is assumed to have a <br /> bearing of east and west. <br /> <br /> 4. That the subject property is located in the R-1R Residential District <br /> and is approximately 10 acres in size. <br /> <br /> 5. That the Applicant was granted a conditional use permit in 1981 to <br /> operate a nursery stock sales lot on the subject property. <br /> <br /> 6. That one of the conditions of the permit issued in 1981 is that any <br /> installation of signs shall be in compliance with local ordinances. <br /> <br /> 7. Section 170.05 of the Ramsay City Code prohibits advertising signs in <br /> R-iR Residential Districts. Section 170.05 also states that <br /> conditional use permits are required for all advertising signs. <br /> <br /> 8. That the Applicant has stated that such conditional use permit is <br /> necessary to properly advertise the nursery and products offered on the <br /> subject property. <br /> <br /> 9. That if granted, the conditional use permit will not grant the <br /> Applicant special privileges that are denied by the City Code to other <br /> commercially used properties. <br /> <br /> 10. That if granted, the conditional use permit will not impair the ' <br /> enjoyment or market value of surrounding properties. <br /> <br /> <br />
