PROPOSED FINDINGS OF FACT <br />REQUEST FOR REZONING <br />THORP FINANCE CORPORATION <br /> <br />1. That Thorp Finance Corporation hereinafter referred to as <br /> ,,Applicant" has properly applied for a rezoning of the properties <br /> at 138th Avenue and Dolomite Street N.W. from B-1 Business to R- <br /> 1U Residential. <br /> <br /> 2. That the Applicant appeared before the Planning and Zoning <br /> Commission for a public hearing pursuant to Section 170.013C of <br /> the city Code on November 1, 1988 and that said public hearing was <br /> properly advertised and that the ~inutes of said public hearing <br /> are hereby incorporated by reference. <br /> <br /> 3. That the properties which are the subject of the application are <br /> located at 138th Ave. and Dolomite St. N.W. and are legally <br /> described as follows: <br /> Lots 2 and 3, Block 5, Riverside West, Anoka County, <br /> Minnesota. <br /> <br /> 4. That Lot 2 is approximate%y 1 acre in size and Lot 3 is <br /> approximately 1.25 acres in size. <br /> <br /> 5. That the subject properties are currently zoned B-1 Business. <br /> <br /> 6. That the property to the south is zoned R-1U Residential. <br /> <br /> 7. That the property to the north of Lot 2 is zoned B-1 Business and <br /> is developed with a church structure. <br /> <br /> 8. That the properties to the east are zoned B-1 Business. <br /> <br /> 9. That the property to the west of Lot 2 is zoned B-1 Business and <br /> the property west of Lot 3 is zoned R-1U Residential. <br /> <br /> 10. That the Applicant has stated that the rezoning is necessary since <br /> the properties have not been able to be sold for commercial <br /> development. <br /> <br /> 11. That the rezoning will/will not substantially adversely impair the <br /> use or market value of any surrounding property. <br /> <br /> 12. That the proposed rezoning will/will not be in accordance with the <br /> specific objectives of the Comprehensive Plan. <br /> <br /> 13. That the proposed rezoning will not change the essential character <br /> of the area. <br /> <br /> 14. That the use of Lot 2 as a residential use may cause adjacent B-1 <br /> properties to incur additional costs due to screening requirements <br /> between B-1 & R-1 uses unless these requirements are waived. <br /> <br /> <br />
