p.m. <br /> <br />Cas, 45: Reouest To Vacate Dfc{nme, Easement On Lot 4. Block 4. <br /> ~orthfork: <br /> <br />On September 27, 1988, Dennis Peck approached Council with a request to <br />vacate the drainage easement on the front half of Lot 4, Block 4, to allow <br />for the sale of the lot and houae accidentally built in the drainage <br />easement. Per Council direction, an alternative drainage plan has been <br />researched and North Pork is proposing to develop a drainage pond on Lot 3. <br /> <br />City Staff presented proposed findings of fact. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Bawden to <br />adopt Findings of Fact 0226, amended as follows, relating to Northfork's <br />request to vacate drainage easement: <br /> <br /> Item 98 shall read: 'The building inspecto~ reviewed both the <br /> certificate of survey and final plat and issued a building permit.' <br /> Item #12 shall read: 'The City Engineer has reviewed the proposed <br /> plan and calculated that the runoff from a 100 year storm would not <br /> impact the drainfield or the residence as currently construct.' <br /> <br /> Add Item 913 to read: 'That the Applicant has agreed to indemnify the <br /> City against all damages resulting from the proposed easement <br /> vacation.' <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, <br />Bawden, DeLuca and Pears on. Voting No: None. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Bawden to <br />adopt Resolution 988-192 vacating a portion of the easement on Lot 4, <br />Block 4, and providing for the construction of a swale and ponding area on <br />Lot 3, Block 4. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councitmembers Sorteberg, <br />DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />~ ~eoue~t To Vacate Drainage Easements On Lots 3 & A, Wood~and <br /> <br />Mr. Otto stated that Mr. Glen Hammerschmidt and Mr. Brock Hammerschmidt are <br />requesting that the City vacate the northerly 50 feet of a 75 feet wide <br />drainage easement on Lots 3 and 4, Block 3, Woodland Green. Mr. Otto <br />stated that the vacation would not impact drainage in the area. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Pearson to <br />adopt Findings of Fact 0227 relating to vacating the north 50 feet of the <br />drainage easement on Lots 3 and 4, Block 3, Woodland Green. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councitmembers <br />DeLuca, Pearson and Bawden.
