Ine./C~tv Of Ramsey Arb{trators: <br /> <br />Mr. Goodrich reported that Dave Perkins Contracting invoked arbitration <br />relating to construction contract for site improvements at River's Bend. <br />The arbitrator found against the City. <br /> <br />Mr. Hartley reported that Hakanson Anderson Associates has offered to pay <br />one half of the costs incurred by Ramsey as a result of the arbitrator's <br />decision. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember DeLuca to <br />authorize the finance director to issue a cheok to Dave Perkins <br />Contracting, Inc. in the amount of $14,701.73 plus scorned interest through <br />October 26, 1988, pursuant to the American Arbitration Association Award <br />dated October i1, 1988. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Coun¢ilmembers Sorteberg, <br />DeLuca, Pearson and Bawden. Voting No: None. <br /> <br />Councilmember DeLuca stated that he would like a determination as to <br />whether or not there is fault with the bid specs or the bidders; if there <br />is fault with bid specs, it should be corrected. <br /> <br />Mr. Rartley replied that the specs were reviewed and seemed to be adequate; <br />during the course of construction there were indicators that suggested the <br />contractor did not have a full understanding of contract responsibilities. <br />It is in Ramsey's best interest to re-eva!utate whether or not standard <br />arbitration will be used to resolve disputes affecting contract <br />interpretation in the future. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Pears on to <br />accept the offer of Rakansou Anderson Associates to pay 50% of the costs <br />incurred by P~msey as a result of the arbitrator's decision in the Dave <br />Perkins case. <br /> <br />}lotion carried. Voting No: None. <br /> <br />Valle,- Estates 2nd Add{t~on: <br /> <br />Mr. Raatikka stated that about a month ago, Council approved Green Valley <br />Estates 2nd Addition contingent upon Mn/DOT approval of accesses. Mn/DOT <br />will not approve one of the proposed entrances and the plat has been <br />redrawn accordingly but it is not acceptable to City Staff. Mn/DOT was <br />again approached but they maintain their position of limiting access onto <br />Hwy. ~47.
