PAUL <br /> <br />1. That Mr, Paul Bertils, hereinafter referred to as "Applzcant , has <br /> applied for a Board of Adjustment Variance from the requlired front <br /> yard setback, <br /> That the Applicant appeared before the Ramsey Board of Adjustment for a <br /> public hearing on September 22, 1988 and that said public hearing was <br /> properly advertised and that the minutes of said public hearing are <br /> hereby incorporated as a part of these findings by reference. <br /> <br /> 3. That the subject property is generally known as 16701 Garnet Street and <br /> is legally described as follows: <br /> Lot 6, Block 3, Now and Then Estates, Anoka County, Minnesota <br /> <br /> 4. That the subject property is located in the R-IR Residential District <br /> and is approximately 2.5 acres in size. <br /> <br /> 5. That the Applicant is requesting a variance from the front yard setback <br /> requirements of Section 170.016A of the Ramsey City Code. <br /> 6."That Section 170.016A of the Ramsey City Code requires a minimum front <br /> yard setback of 40 feet. <br /> <br /> 7. That the Applicant is requesting a variance for an encroachment of <br /> approximately 7 feet to the front yard setback requirement. <br /> <br /> 8. That the Applicant has stated that there is an exceptional circumstance <br /> applying to the subject property. Namely, that the unusual 'S' curve <br /> to the front property line resulted in an incorrect measurement and <br /> the eventual placement of the home foundation within the front yard <br /> setback. <br /> <br /> 9. That the granting of such a variance is/is not necessary to the <br /> preservation of substantial property rights. <br /> <br /> 10. That the special conditions or circumstances do result from the actions <br /> of the Applicant. <br /> <br /> 11. That the granting of the variance requested will not grant the <br /> Applicant any special privilege that is denied by this chapter to other <br /> owners of lands in the same district. <br /> <br /> 12. That the variance requested is the minimum variance which would <br /> alleviate the hardship. <br /> <br /> 13. That the variance will not be materially detrimental to the purposes of <br /> this chapter, or other property in the same zone. <br /> <br /> 14. That the variance will not substantially increase the congestion of <br /> public streets or endanger the public safety or substantially impair <br /> property values within the neighborhood· <br /> <br />15. <br /> <br /> <br />
