~ROPOSED FINDINGS OF FACT <br />fD~o GARY M~NKHOLM <br />15657 JUNIPER RIDGE, MN <br /> <br />That Mr. Gary Nunkholm, hereinafter referred to as "Appllcant", has <br />properly applied for a Board of Adjustment Variance from Section <br />170.076 of the Ramsey City Code regarding the required setback from the <br />Rum River· <br /> <br />That the Applicant appeared before the Board of Adjustment for a public <br />hearing pursuant to Sections 170.013G and 170.076 of the City Code on <br />September 22, 1988 and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated as <br />part of these findings by reference· <br /> <br />That the subject property is generally known as 15657 Juniper .idge <br />Drive N.W. and is legally described as follows: <br /> <br /> Lot 6, Block I, Reilley Estates, Anoka County, Minnesota <br /> <br />That the subject property is located in the R-1R Rural Residential <br />District and is approximately one acre in size. <br /> <br />That the subject property is located in the Scenic River Overlay <br />District. <br /> <br />That Section 170.076 of the City Code requires all structures to be set <br />back at least 150 feet from the Rum River. <br /> <br />That the Applicant is proposing to construct a home on the subject <br />property that will encroach the Rum River setback by approximately 45 <br />feet. <br /> <br />8. That the Applicant has stated that the variance to the Rum River <br /> setback requirements is necessary in order to maintain a 40 foot front <br /> yard setback in accordance with Ramsey City Code. <br /> <br />9. That the residence on the property to the northwest is located <br /> approximately 100 feet from the Rum River and the residence on the <br /> property to the southeast is located approximately 113 feet from the <br /> Rum River. <br /> <br />10. <br /> <br />That the Applicant has stated that there are unique circumstances <br />applying to the subject property in that the subject property is <br />subject to the restrictions of the Scenic River Ordinance which do not <br />generally apply to other properties in the R-1R Rural Residential <br />District· <br /> <br />Ii. That the Applicant has stated that the variance is necessary for the <br /> preservation of a substantial property right. <br /> <br />12. That the special circumstances, that the property is located'in the <br /> Scenic River Overlay District, do not result from the actions of the <br /> Applicant. <br /> <br /> <br />
