PROPOSED FINDINGS OF PACT <br />~. STEVE COtfPTON <br /> <br />1. That Hr. Steve Co~pton, hereinafter referred to as "Applicant", has <br /> properly applied for a Board of Adjustment Variance from Section <br /> 170.015G of the City Code. <br /> <br />2. That the Applicant appeared before the Board of Adjustment for a public <br /> hearing pursuant to Section I?0.013G of the City Code on October 2?, <br /> 1988 and that said publlc hearing was properly advertised and that the <br /> minutes of said public hearing are hereby incorporated as a part of <br /> these findings by reference. <br /> <br />3. That the subject property is generally known as 7250 166th Avenue N.W. <br /> and is'legally described as follows: <br /> <br /> That part of the west 225 feet of the east 675 feet (as measured along <br /> the north line) of the southeast quarter of the southeast quarter of <br /> Section 9, Tc~nshlp 32, Range 25, lying north of a llne bearing south <br /> 89 degrees 14 minutes 32 seconds vest from a point in the east line of <br /> said southeast quarter of southeast quarter distant 523.3 feet north <br /> of the southeast corner thereof the south line of said southeast <br /> quarter of southeast quarter is assumed to bear due east and west <br /> (subject to road easement over the south 33 feet thereof) (subject to <br /> easement of record). <br /> <br /> 4. That the subject property is located in the R-1R Residential District <br /> and is approximately 4 acres in size. <br /> <br /> 5. That the Applicant is requesting a variance from Section 170.015G of <br /> the City Code in order to construct a garage 80 feet nearer the front <br /> lot line than the principal structure on the lot. <br /> <br /> 6. That Section 170.015G of the City Code specifies that no accessory <br /> structure shall be constructed nearer the front lot line than the <br /> principal structure. <br /> <br /> 7. That there are exceptional conditions applying to the property that do <br /> not generally apply to other properties in the district. Namely, that <br /> the placement of an accessory structure on the subject property is <br /> limited by wetlands, varying topograhy, mature tree grOwth and on-site <br /> septic system. <br /> <br /> 8. That the Applicant has stated that such a variance is necessary for the <br /> preservation of a substautial property right similar to that possessed <br /> by other properties in the area. <br /> <br /> 9. That the exceptional conditions (wetlands, varying topography, :ature <br /> tree growth and on-site septic system) do not result from the acticns <br /> of the Applicant. <br /> <br /> <br />
