PROPOSED FINDINCS OF FACT <br />MS, VIR. GINIA BUTTBB.FIZLD <br /> <br />I. That Ms. Virginia Butterfield, hereinafter referred to as "Applicant", <br /> has properly applied for a Board of Adjustment Variance from Section <br /> 170.015C of the City Code regarding accessory structures and Sections <br /> I?0.O15F and I?0.016A of the City Code regarding setback from <br /> thoroughfares. <br /> <br />2. That the Appllcant appeared before the Board of Adjustment for a public <br /> hearing pursuant to Section 170.013G of the Ramsey City Code on October <br /> 27, 1988 and that said public hearing was properly advertised and the <br /> minutes of said publlc bearing are hereby incorporated aa part of these <br /> findings by reference. <br /> <br />3. That the subject property is generally known as 16120 Novthen Blvd. <br /> N.W. and is legally described as follows: <br /> The east 128.0 feet as measured along the north and south lines of the <br /> north 394.7 feet as measured on the east and west lines of the <br /> northwest quarter of the southeast quarter of Section 15, To~nshlp <br /> Range 25, Anoka County, Minnesota. <br /> <br /> 4. That the subject property is located in the R-iR Rural Residential <br /> District and is approximately .5 acres in size. <br /> <br /> 5. That Sections 170.01~F and 170.016A of the City Code require a minimum <br /> setback of 110 feet from the centerline of thoroughfares. <br /> <br /> 6. That Section 170.015G of the City Code which prohibits the placement of <br /> accessory structnres nearer the front lot line that the principal <br /> <br /> 7. That the Applicant had an accessory struoture on the subject property <br /> located approximately 106 feet from the centerline of Nowthen Blvd. <br /> N.W. and 9 feet nearer the front property line than the principal <br /> <br /> 8. That the Applicant's accessory structure was constructed prior to the <br /> adoption of the 100 foot setback from thoroughfares and the adoption <br /> of that code prohibiting placement of accessory structures nearer the <br /> front property line than the principal structure. <br /> <br /> 9. That more than 50% of the Applicant's accessory structure was destroyed <br /> by fire in 1988. <br /> <br /> 10. That Section 170.015H of the City Code requires all nonconforming uses <br /> that are more than 50% destroyed to conform to the current City Code. <br /> <br /> 11. That the Applicant is proposing to construct the accessory structure on <br /> the site of the original structure. <br /> <br /> 12. That the Applicant is requesting a variance of approximately 4 feet <br /> from the required setback from the centerline of Nowthen Blvd. N.W. and <br /> a variance to reconstruct the structure approximately 9 feet nearer the <br /> front property line than the principal structure. <br /> <br />7 <br /> <br /> <br />
