PROPOSED FINDINGS OF FACT <br />CONDITIONAL USE PERMIT <br />DAVID SCHULTE <br /> <br />1. That Mr. David Sohulte, hereinafter referred to as "Applicant," has <br />property applied for a conditional use permit to excavate materials in the <br />R-1R Rural Residential district. <br /> <br />2. That the Applicant appeared before the Ramsey Planning and Zoning <br />Commission for a public hearing pursuant to Sections 170.013D and 170.017M <br />of the Ramsey City Code on August 2, 1988 and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby <br />inoorporated as a part of these findings by reference. <br /> <br />3. That the subject property is legally described as follows: <br /> <br />Lots 6, 7, 8, 9, and i0, Block 1, Oakwood Hills, Anoka County, <br />Minnesota. <br /> <br />4. That the subject property is located in the R-IR Rural Residential <br />district and is approximately 12 acres in size. <br /> <br />5. That the Applicant is requesting a conditional use permit to excavate <br />approximately cubic yards of materials from the subject property. <br /> <br />6. That the Applicant is proposing to excavate and mine materials in the <br />process of constructing Xenon Street in the plat of Oakwood Hills. <br /> <br />7. That excavating and mining are not permitted uses in any distriot in <br /> the City. <br /> <br />8. That Section 170.017M of the Ramsey City Code permits grading in <br />conjunction with the platting process; however, this section of the Code <br />does not permit the mining and removal of materials from the site. <br /> <br />9. That the adjacent properties are zoned for residential development. <br /> <br />10. That in the past, the City has approved requests for conditional use <br />permits to excavate materials. <br /> <br />11. That the Applicant has stated that the antioipated duration of the <br />proposed excavating operation is approximately months. <br /> <br />12. That the proposed excavation operation will generate approximately <br />trucks hauling materials daily. <br /> <br />13. That access to the subject property will be from County Road No. 5. <br /> <br />14. That the proposed excavation operation will increase temporarily <br />increase traffic in the area. <br /> <br />15. That the proposed excavation operation will not permanently adversely <br />impair the enjoyment of use of surrounding properties. <br /> <br />16. That the traffic generated by the proposed excavation operation will be <br />temporarily disturbing to adjacent properties. <br /> <br /> <br />
