ADDENDUM <br /> <br />Conditional Use Application - Brief Description of the Request <br /> <br /> The Applicant is requesting a conditional use permit pursuant <br />to Ramsey Zoning Ordinance ~170 to allow the following uses for <br />the property legally described on Exhibit A ("Property") attached <br />hereto: <br /> <br />. (1) <br /> <br />Use land currently zoned for industrial use for Vertical <br />Expansion of the existing landfill with at least 635 <br />acre feet of additional landfill capacity; <br /> <br />Use land currently zoned as industrial and residential <br />for construction of a tow rope, warming house and <br />adjacent parking facilities and perimeter fence and <br />operation of a ski hill and sledding recreational <br />facility in connection with the above-described <br />improvements; <br /> <br />(3) Rough grading of a road right-of-way; and <br /> <br />(4) Excavation, grading and transporation of soil materials <br /> for use as landfill cover material. <br /> <br /> Applicant has agreed to use the Property in accordance with <br />the terms of the Development Agreement attached. A preliminary <br />site plan showing the approximate location of the proposed <br />improvements is attached as Exhibit B to the Development <br />Agreement. <br /> <br /> Applicant contends that it can proceed with the Vertical <br />Expansion without obtaining a conditional use permit from the <br />City. By submitting this application Applicant does not waive <br />any rights that it has to expand the existing landfill located on <br />the Property.as a non-conforming pre-existing use or as otherwise <br />may be permitted or required by applicable law. Applicant hereby <br />reserves the right to expand the landfill as a non-conforming use <br />in the event that the conditional use permit is denied or if the <br />terms of the permit are unacceptable to Applicant. <br /> <br /> <br />
