Any rights conferred on the Permit <br />Holder by this Permit are personal to the Permit Holder. The city <br />is issuing this Permit on the basis of the credit and reputation <br />of the Permit Holder. The Permit Holder shall not assign or <br />transfer this permit without first obtaining approval of the City <br />which may allow or disallow such transfer in its absolute and sole <br />discretion. In the event the City declines for any reason to <br />allow the transfer of this Permit, the Permit Holder shall either <br />continue landfill operations in full compliance with the terms of <br />this Permit or terminate landfill operations. <br /> <br />Annual Review. This permit and the performance of the owner shall <br />be reviewed annually by the City at least 60 days prior to the <br />anniversary date of the permit date. Required insurance certifi- <br />cates and appropriate bonds shall be submitted to the City prior <br />to the anniversary date of the permit. <br /> <br />Post-Closure Care. The Permit Holder shall institute long-term <br />care measures to maintain all slopes, swales, settlement points, <br />monitoring points, and to care for erosion and vegetation damage. <br />The Permit Holder shall inspect the site on a quarterly basis for <br />the first three years, thereafter.on a semi-annual basis unless <br />otherwise approved or directed by MPCA. <br /> <br />On-Site Inspection. The city reserves the right to inspect the <br />Landfill Si{e for the purposes of examining and copying <br />nonprivileged records; conducting inspections, surveys, <br />investigations, monitoring, or sampling; and others obtaining <br />necessary information pertaining to the construction, operation <br />and environmental effect of the demolition landfill facility, <br />control equipment and control materials. Inspections shall be <br />conducted during normal business hours except in the event of an <br />emergency, city personnel or agents performing the inspection <br />will notify personnel at the business office at the ~ime of <br />inspection. <br /> <br />indemnity. The permit holder shall indemnify, defen~ and hold the <br />City ha.~less from all claims, demands, and/or actions legal <br /> land~_l! site. <br />and/or eq~uitab!e arising from the opera~ions on the ~ <br /> <br />Documents and Maps.
