ADDENDUM Conditional Use Application - Brief Description of the Request The Applicant is requesting a conditional use permit pursuant to Ramsey Zoning Ordinance §170 to allow the following uses for the property legally described on Exhibit A ("Property") attached hereto: (1) Use land currently zoned for industrial use for Vertical Expansion of the existing landfill with at least 635 acre feet of additional landfill capacity; (2) Use land currently zoned as industrial and residential for construction of a tow rope, warming house and adjacent parking facilities and perimeter fence and operation of a ski hill and sledding recreational facility in connection with the above-described improvements; (3) Rough grading of a road right-of-way; and (4) Excavation, grading and transporation of soil materials for use as landfill cover material. Applicant has agreed to use the Property in accordance with the terms of the Development Agreement attached. A preliminary site plan showing the approximate location of the proposed improvements is attached as Exhibit B to the Development Agreement. Applicant contends that it can proceed with the Vertical Expansion without obtaining a conditional use permit from the City. By submitting this application Applicant does not waive any rights that it has to expand the existing landfill located on the Property as a non-conforming pre-existing use or as otherwise may be permitted or required by applicable law. Applicant hereby reserves the right to expand the landfill as a non-conforming use in the event that the conditional use permit is denied or if the terms of the permit are unacceptable to Applicant.
