PAUL, MN. 55106 FI~NO. <br /> <br />July 29, 1988 <br /> <br />AU$2-IRRR <br /> <br />Ms. Anne Norris <br />City of Ramsey <br />15153 Nowthen Blvd. N.W. <br />Ramsey, MI~. 55303 <br /> <br />Dear Ms. Norris: <br /> <br />RE: WASTE MANAGEMENT OF MINNESOTA, INC. - CONDITIONAL USE PERMIT <br /> REVIEW, PROTECTED WETLAh~ #2-657W <br /> <br />I have reviewed the material submitted for the proposed ski hill <br />development plan which includes a road crossing of protected wetland <br />#2-657W and offer the following comments: <br /> <br />Placement of fill by a private corporation for a road <br />crossing of a wetland is not permissible under DNR rules <br />Part 6115.0190, Item F, which makes an exception for the <br />placement of fill for a road crossing only where it is <br />proposed by a federal, state, or local government agency. <br />If the road were to be a public street, then specific <br />provisions under that rule require that there be a finding <br />of no feasible or practical alternative to avoid the wetland <br />and that the public need has been established for the <br />project ruling out the no-build alternative. <br /> <br />Placement of fill in the wetland exceeds one <br />area; therefore a mandatory environmental <br />worksheet is required under the EQB rules. <br /> <br />(1) acre in <br />assessment <br /> <br />The %~itten materials submitted indicate that watering <br />trucks will be used to control dust during earth moving <br />activities.
