PROPOSED FII/DII~CS OF FACT <br />MR. HIKE EASON <br /> <br />1. That Mr. Mike Eason, hereinafter referred to as "Applicant", has <br /> properly applied for a conditional use permit to operate a small engine <br /> and auto repair shop on the property owned by Mr. Ronald Fischl and <br /> located at 15850 St. Francis Blvd. N.W. <br /> <br />2. That the Applicant appeared before the Planning and Zoning Commission <br /> for a publc hearing pursuant to Section 170.016 of the Ramsay City Code <br /> on October 4, 1988 and that said public hearing was properly advertised <br /> and that the minutes of said public hearing are hereby incorporated by <br /> reference. <br /> <br />3. That the property which is the subject of the application is located at <br /> 15850 St. Francis Blvd. N.W. and is legally described as follows: <br /> The south 450 feet of the north 516 feet of the southeast one quarter <br /> of the southeast one quarter of Section 14, Township 32, Range 25, <br /> lying west of the cen:erline of State Trunk l{ighway 47. <br /> <br /> 4. That the subject property is zoned K-1R Residential and is <br /> approximately 9.5 acres in size. <br /> <br /> 5. That surrounding properties are zoned R-iR Residential. <br /> <br /> 6. That a repair shop is no= a permitted use in the R-iR Residential <br /> District. <br /> <br /> 7. That the Applicant is not the ~,ner of the subject property. <br /> <br /> g. That if the Applicant is granted the conditional use permit, the owner <br /> of the property has agreed to comply with the terms of the permit. <br /> <br /> 9. That there are/are not similar permitted conditional uses in the City. <br /> <br /> 10. That the proposed use will not be unduly dangerous or detrimental to <br /> persons residing or wcrking in the area. <br /> <br /> 11. That the proposed use will not substantially adversely impair the use, <br /> enj~,ment or market value of any surrounding property. <br /> <br /> 12. That the proposed use will/will not be harmonious with and in <br /> accordance with the specific objectives of the Comprehensive Plan. <br /> <br /> 13. That the Applicant has stated that the proposed use will be operated <br /> and maintained so as to be harmonious and appropriate in appearance <br /> with the existing or intended character of the R-iR Residential <br /> District. <br /> <br /> 14. That the proposed use will not be hazardous or disturbing to existing <br /> or future neighboring uses. <br /> <br /> <br />
