1. The granting of a Conditional Use Permit shall be in accordance with procedures and <br /> criteria established in item C, Purpose and Intent, of this Section and the Zoning <br /> Regulations Section 9.03.04. <br /> <br />2. A conditional use development shall not be permitted if said development is expected to <br /> cause erosion or sedimentation, an intrusion into a scenic area, disruption of a wildlife <br /> habitat, removal of extensive areas of vegetation or has a potential for a similar adverse <br /> effect upon a portion of the Mississippi River Overlay District. <br /> <br />K. General Provisions. <br /> <br />1. The General Provisions are established to provide a high standard of development and <br /> protection of the natural environment in the Mississippi River Overlay District. <br /> <br />2. Site Development Plans. <br /> <br />A site development plan shall accompany a building permit, site plan, preliminary <br />plat, final plat, excavation permit, conditional use permit or other permit process <br />required for development in the Mississippi River Overlay District in accordance <br />with the provisions of this code and all other applicable codes of the City. When a <br />site plan is required under City Code Section 9.03.08, it shall be used with the review <br />criteria in the section to satisfy site development plan requirements in this Section. <br />The submittal of an additional site development plan is not required to satisfy the <br />requirements of this Section. <br /> <br />Site Development Plan Revision. After a site development plan has been approved, <br />an applicant may request a revision at any time by requesting said revision in writing <br />to the Community Development Director. <br /> <br />c. Site Development Plan Deviation. No deviation from the approved site plan shall be <br /> permitted at any time without first obtaining approval of a revision as stated above. <br /> <br />Site Development Plan Contents. Site plan information as deemed necessary by the City <br />shall be as shown on the application form provided by the City and related to scale, name <br />and address of owner(s), existing topography, existing and proposed drainage, proposed <br />grading or filling, soil information, existing vegetation, vegetation proposed to be <br />removed, existing buildings, landscape plan, proposed structures, proposed driveways <br />and parking areas, proposed utilities and similar information. <br /> <br />Additional information found necessary to insure compliance with the provisions of this <br />code may also be required. <br /> <br />L. Site Development Plan Standards. No site plan which fails to satisfy the following standards <br /> shall be approved by the City. <br /> <br />Filling in a wetland shall not exceed the excess storage and nutrient stripping capacities <br />of the wetland based on the ultimate projected development of the wetland watershed. <br />The method and criteria used to establish nutrient stripping capacity is contained in the <br />City's Procedures Manual. As the Local Govemmental Unit (LGU), the Lower Rum <br />River Water Management Organization (LRRWMO), under the Wetland Conservation <br />Act (WCA) will review impacts of development 6n wetlands.
