protected waterbodies are proposed, the LRRWMO shall notify the DNR Division of <br />Waters. <br /> <br />Dredging of water bodies shall be permitted only when it will not have a substantial or <br />significant adverse effect on the ecological and hydraulic characteristics of the water <br />body and is proposed for a purpose consistent with the Critical Area designation. Any <br />dredging of wetlands or other waterbodies should comply with all standards of the U.S. <br />Army Corps of Engineers, Department of Natural Resources, and all other applicable <br />state and federal agencies. <br /> <br />3. No development shall be permitted on land having a slope before alteration in excess of <br /> 12 percent. <br /> <br />4. The following additional conditions for the development on slopes up to I2% shall be <br /> met: <br /> <br />a. The foundation and underlying material of any structure, including roads, shall be <br /> adequate for the slope condition and soil type. <br /> <br />Adequate controls and protections exist uphill from the proposed development such <br />that there is no danger of structures or roads being struck by falling rock, mud, <br />uprooted trees, or other materials, and soil shall be controlled. <br /> <br />c. The proposed development presents no danger of falling rock, mud, uprooted trees or <br /> other materials, to structures downhill. <br /> <br />The view of the developed slope from the river and opposite riverbank is consistent <br />with the natural appearance of the undeveloped slope, consistent with any historic <br />areas nearby, compatible with the view from historic areas and compatible with <br />surrounding architectural features. To the maximum extent possible, the use of <br />natural devices, including vegetation management, shall be preferred over the <br />construction of artificial devices, including culverts, holding ponds, walls and <br />terracing. <br /> <br />Buildings shall be designed in a manner appropriate to their surroundings and minimize negative <br />impacts to slopes and vegetation. The use of retaining walls to facilitate site and/or building <br />development is highly discouraged. The use of retaining walls shall be limited to circumstances <br />when other site development alternatives are not feasible and the use of retaining walls will <br />preserve vegetation, provide enhanced vegetation and is considered a benefit to the corridor. <br /> <br />Any lift stations required to service the slope development with local sewer systems, <br />are designed in accordance with local design standards and approved by the City <br />Engineer. The applicant shall furnish a satisfactory arrangement or agreement by <br />which the cost of maintenance and operation of the lift station are borne by those <br />serviced by the facility. <br /> <br />No septic tank shall be placed on a slope of greater than 12%.
