All that part of the south 729.11 feet of the north half of the Southeast Quarter of Section 23, Township 32, Range 25, Anoka County, Minnesota, lying easterly of the centerline of County State Aid Highway No. 5 per Document No. 455358. Except that part platted as Holaseks Addition, according to the recorded plat thereof, Anoka County, Minnesota and except that part thereof described as follows: Beginning at a point on the north line of the south 554.81 feet of said north half of the Southeast Quarter, distant 1200.00 feet west of the east line of said north half of the Southeast Quarter, as measured along said north line; thence on an assumed beating of south 88 degrees 51 minutes 38 seconds west, along said north line, a distance of 312.65 feet, to the c'enterline of County State Aid Highway No 5, per Document No. 455358; thence south 30 degrees 30 minutes 00 seconds east, along said centerline, to the south line of the north 217.80 feet of said south 554.81 feet; thence north 88 degrees 51 minutes 38 seconds east, along said south line, a distance of 68.84 feet~ to the easterly right of way line of said County State Aid Highway No. 5 and a point hereinafter referred to as Point "A"; thence south 30 degrees 30 minutes 00 seconds east, along said easterly right of way line, a distance of 14.00 feet; thence north 80 degrees 05 mintites 43 seconds east, to said south line, dish'mt 86.00 feet east of said Point "A" as measured along said south line; thence north 88 degrees 51 minutes 38 seconds east, from the point of beginning; thence north 30 degrees 30 minutes 24 seconds west, a distance of 249.91 feet, to the point of beginning. -or upon recording- Lots 1-22 Block I; Lots 1-17 and Outlot A, Block 2; Lots 1-7, Block 3; Lots 1-5, Block 4; Lots 1-3, Block 5; MEADOW, Anoka County, Minnesota (the "Subject Property"); and WHEREAS, on February 28, 2006, pursuant to Resolution No. 06-02- , the CITY approved the final plat of the Subject Property, which plat is known as MEADOW (the "Plat"), which approval is contingent on certain requirements, including the DEVELOPER and the CITY entering into this Agreement; and WHEREAS, the final plat for the Subject Property conforms to the preliminary plat for Meadow; and WHEREAS, the DEVELOPER has received approval from the Metropolitan Council of the request for Comprehensive Plan Amendment to reconfigure the Subject Property's land use designations in the City's Comprehensive Plan, which designations consist of places to shop, Iow density residential, and public-quasi-public; and WHEREAS, the CITY requires certain improvements to be constructed within the Plat, which improvements are defined as Stage I and Stage II Improvements in the City Code; and -156- ~leadow Subdivision Development Agreement Page 2 of 12
