CASE # <br /> <br />REQUEST FOR AN AMENDMENT OF AN INTERIM USE PERMIT TO ALLOW FOR <br />THE OUTDOOR DISPLAY OF VEHICLES FOR SALE: <br /> CASE OF BRAD LANO <br /> By: Breanne Dairies, Associate Planner <br /> <br />Background: Brad Lano has requested an amendment to the approved Interim Use Permit to <br />allow retail sales and outdoor display of merchandise. The original Interim Use Permit was <br />approved by the City Council on December 13, 2005, and allowed for the sales and outdoor <br />display of vehicles. The applicant has requested that the permit be amended and approved for <br />retail sales and outdoor display generally, and not be restricted to vehicles. <br /> <br />The following items are enclosed for your information: <br /> a) Site location map <br /> b) Site Plan <br /> c) Proposed Amended Findings of Fact <br /> d) Proposed Amended Interim Use Permit <br /> <br />Observations: <br /> <br />On September 27, 2005, Lmmx, LLC submitted an application for a Conditional Use Permit to <br />allow the sales and outdoor display of vehicles on the property located at 6246 Highway 10, <br />owned by Brad Lano. The Planning Commission recommended denial of the request, due to the <br />inconsistency with the Comprehensive Plan. The City Council heard the case on November 22, <br />2005, and decided that, while inconsistent with the long-term goals for this area, the current <br />surrounding land uses were compatible with outdoor display and sales of vehicles. <br /> <br />On December 13, 2005, the City Council approved an Interim Use Permit to allow the sales and <br />outdoor display of vehicles for a period of two years, renewable for an additional two years. <br /> <br />Since December, Brad Lano has found another potential lessee for the property. This company <br />would like to use the property for the sales and assembly of gazebos. While the manufacturing <br />component of the business conforms to the zoning requirements, the user would also like to sell <br />and display the gazebos outdoors, which requires a conditional use permit. Because the approved <br />permit specifically allows outdoor display and sales of vehicles, an amendment to the original <br />Interim Use Permit is required. The permittee seeks to amend the Interim Use Permit to more <br />generally allow retail sales activities and outdoor display. <br /> <br />The subject property is zoned E-1 Employment. According to City Code, retail sales and outdoor <br />display requires a conditional use permit. An amended interim use permit is required to allow for <br />these uses. <br /> <br />-179- <br /> <br /> <br />
