Such <br /> testing is required before any final plat may be approved, <br /> but may be waived by the zoning administrator when adequate <br /> data is already available. <br /> <br />170.079.2 Planned Unit or Cluster Developments may be allowed in the <br /> Scenic River Land Use District if preliminary plans are first <br /> approved by the Commissioner of Natural Resources and the <br /> applicable provisions of Minnesota Regulations NR 78-g4 per- <br /> taining to such development are satisfied, and the R~m~ey <br /> City Code is satisfied. <br /> <br />170.0710 LANDSCAPE ALTERATIONS <br /> <br />170.0710.1Vegetative Cutting <br /> <br />170.0710.il The vegetative cutting provisions of Section 170.0710.12 <br /> shall apply to those areas as specified in Sections <br /> 170.076.110, 170.076.28 and 170.076.33 of this Ordinance. <br /> <br />170.0710.12 General Provisions Within Designated Setback Areas: <br /> (1) Clear cutting, except for any authorized public ser- <br /> vices such as roads and utilities~ shall not be per- <br /> mitted. <br /> (2) Selective cutting of trees in excess of four inches <br /> in diameter at breast heights shall be permitted pro- <br /> viding' cutting is spaced in several cutting operations <br /> and a continuous cover is maintained. <br /> (3) The cuttlng provisions of Section 170.0710.12(1) and <br /> (2), shall not be deemed to prevent: <br /> (a) The r~moval of diseased or insect infested <br /> trees, or of rotten or d~m~ged trees that <br /> present safety hazards. <br /> (b) Pruning understory vegetation, shrubs, plants, <br /> brushes, grasses, or from harvesting crops, <br /> or cutting suppressed trees or trees less than <br /> four inches in diameter at breast height. <br /> <br /> <br />
