COUNCIL OLD BUSINESS

1. Section 110.09 Cit~ Coder(Kee2in~ of. Certain. Animals in the...CitM);' ~
~Oa~uf--Eo~r~.~ugent~i65-~een-Vatiey-RoadJ-~ ..... --~ '' ~_~.~

City Administrator Schnelle said Mr. Nugent has always been cooperative
when city staff has beento his residence on complaints. He explained
that Mr. Nugent is tired of the city's harassment and feels he is being
singled out,

City Attorney Goodrich said being"there are neighbors present against
Mr. Nugent~ .the City Council should not be the judge of 'this matter.
should be settled in court.

It

Mr. Nugent said he felt he was being singled out.

Councilman Cox said he questioned the ordinance h~elf because he was not
aware that the ordinance stated that goats, pigs or cow carmot be
m~intained on any parcel of land in the City of Ramsey. He said it
appears that anybody who has these animals is in violation of the Ordinance
and shomld have a variance.

City Attorney Goodrich said that is one chapter of the ordinance, but
there is also another chapter on having animals that are causing a nuisance.
He explained there is no problem unless the a~mals cause a nuisance-and
it is not a nuisance unless there is a complaint.

City ~m~nistrator Schnelle explained that the reason Mr. Nugent was present
at the meeting is because he thinks the ordinance is unfair.

Mr. ~Nugent said the city does not have the right to tell a person they
cannot farm.

Councilman Cox explained that the~ council is addressing the ordinance here
and is trying to.address what would help the whole c~ty. He said there
will always~be agricultural land adjacentLto residenti~_l areas. He suggested-
individuals be advised directly of ordinance changes so they know what to do.

City Administrator Schnelle said if the city puts them under a conditional
use permit, they will be more aware of the ordinance requirements.

Councilman Cox said he would be in favor of .the City Attorney talking to
both sides to see if they can find some common ground.

Mr. Nugent said he didn't smell the odor from his ten sows and he ~idn't
have 'air conditioning like the other houses in the area.

City ~uistrator SchneLle told Mr. Nugent the fence he put up is not
creating good relations with his neighbors.

Mr. N. ugent said he was going to keep on farming and having hogs and cattle.

Mr. M~ike VilleneuVe~'6230'-'177th Ave. N.W.

Mr. Villeneuve asked the City Council if the ordinances that were broken
in this case were in effect at the time Mr. Nugent moved to P~ey in 1975.

C/June 10, 1980-_
Page 6
