AMENDED <br />PERFORMANCE CONTRACT WITH <br />THE CITY OF RAMSEY <br /> <br /> THIS AGREEMENT, made and entered into this 8th day of October, <br />1980 by and between the city of Ramsey, located in Anoka County, State <br />of Minnesota, hereinafter referred to as the "City" and Barthel Homes, <br />Inc., having its principal place of business at 21370 Sesame Street, <br />Rogers, Minnesota 55374, hereinafter referred to as the "Developer". <br /> I. <br /> <br /> WHEREAS, the parties hereto have previously entered into a <br /> performance contract relating to the development of the plat known <br /> as "Barthel's Rum River Acres 2nd Addition", said contract being <br /> dated October 12, 1979~ and <br /> II. <br /> <br /> WHEREAS, the Developer has now applied to the City to extend for <br /> one (1) year the completion date of the blacktop improvements described <br /> in Paragraph 2) of the October 12, 1979 contract, and III. <br /> <br /> WHEREAS,.the Developer has now applied to the City for permission <br /> to substitute for the letter of credit required in Paragraph 4) of the <br /> October 12, 1979 original contract a second mortgage running to the <br /> city encumbering the entire plat of "Barthel's Rum River Acres 2nd <br /> Addition", said second mortgage to be in the amount of Two Hundred <br /> · Thirty-three Thousand Eight Hundred Fifty and 00/100 ($233,850.00) <br /> <br /> Dollars, and <br /> <br /> IV. <br /> <br /> WHEREAS, in consideration for permitting the amendments described <br /> in Paragraphs II and III above, the Developer agrees to waive any and <br /> all rights it has or may have to obtain building permits for any of <br /> <br /> <br />
