Smith <br />6820 - 158th Avenue N.W. <br />Anoka, Minnesota 55303 <br /> <br />~Dear Mrs. Smith:' <br /> I am writing this letter to confirm the Ramsey City Council's action <br /> on November 10, 1980 regarding the easement and assessment of your <br /> property on 158th Avenue N.W, To summariz~ the Council's action at <br /> the meeting was to agree to abate $950.00 of the 1980 street improve- <br /> ment project assessed against your two (2) lots. <br /> As consideration for this abatement, the City will then receive from <br /> you a permanent drainage easement across your easterly lot which is <br /> known as tax parcel ~89215-6645. You will recall that at the council <br /> meeting I showed you a half section sheet with the exact location of <br /> the easement surveyed out. I am enclosing a copy of the relevant <br /> portion of that half section sheet for your information which copy <br /> does graphically show the drainage utility easement. <br /> ~In order to conclude this matter, I am enclosing a quit claim deed <br /> which legally describes the easement area that you will be conveying <br /> to the City. I would request that after you have reviewed the easement <br /> and the survey which I am enclosing that you then take the easement <br /> deed to the City offices and discuss with Lloyd Schnelle the specific <br /> procedures on how the $950.00 will be credited to you. <br /> Also, to confirm the Council's agreement with you, it is my understanding <br /> that you agreed that within the easement area a ditch may be constructed <br /> allowing the water to flow off 158th to the south toward your property <br /> boundary. The City also gives you the assurance that the ditch area <br /> will be built up such that there will be no back flow from the low area <br /> to the south of your property and any fill materials needed in order to <br /> do this will be taken off your property from the swamp area to the south. <br /> <br /> <br />
