RESOLUTION 1180- <br />WHEREAS, the Ramsey City Council finds that substantial <br />economic savings will exist if the City permits required subdivisions im- <br />provements to be financed through the M.S.A. Chapter 429 special assess- <br />ment procedures; and <br />WHEREAS, the City Council finds that said economic benefit <br />will benefit both the City and the developer, thereby being a <br />the financial welfare of the citizens of Ramsey; and <br />429 <br />WHEREAS, the City Council finds that the M.S.A. Chapter <br />over <br />financing procedure gives the City better quality and timing <br />installation of the required improvements which control is beneficial to the <br />welfare of the citizens of Ramsey. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL, CITY OF RAMSEY, ANOKA <br />COUNTY, MINNESOTA, as follows: <br />1) That the City of Ramsey establishes as policy the right of <br />any developer to apply to the City to finance the required subdivision im- <br />provements through the Chapter 429 special assessment procedure, including <br />residential, commercial and industrial subdivisions. <br />2) That notwithstanding paragraph No. 1 above the City Council <br />must still approve the Chapter 429 procedure in accordance with the State <br />law relating thereto and nothing in this resolutionaisointended t a <br />the City Council's right to approve to disapprove, <br />429 improvement projects on a project by project basis. <br />3) <br />That if the Chapter 429 procedure is approved the following <br />shall be required: <br />a) That the developer enter into a performance contract <br />with the City detailing the various soe elements <br />im- <br />and <br />provement project, its financing, subdivision <br />code re- <br />requiring compliance with all City <br />quirements, City resolutions and policys. The developer <br />d <br />shall deposit with the City escrow amounts guarantee form <br />a andt <br />amount approved by the City in order to g P ym <br />of the above costs. <br />b) That the Developer shall agree to fully reimburse the <br />City for all costs incurred by the City including, but not <br />limited to, the actual cost of construction of said improve- <br />ments, engineering fees, legal fees inspection easements, <br />terest fees, costs of acquisition of necessary <br />if any, and any other cost incurred by the City relating <br />to the Development Contract and the installation of the im- <br />provements. <br />
