• <br />within thirty (30) days after receipt from the planning commission. <br />If the city council denies the application, that action shall be the <br />city's final administrative action on the application. <br />3. if the city council approves the application, as a con- <br />dition of that approval, the council may attach such conditions as <br />it deems necessary. All development, construction and use shall be <br />the <br />in accordance with the approved plan and conditions required <br />eb <br />city council. Any development not in accord with the app <br />and conditions shall constitute a violation of this chapter. The <br />conditions imposed shall be imposed only in order to protect the <br />public health, safety, convenience and welfare or toavidttraffic <br />congestion or hazard, or other dangers, or to promot e orn o <br />property and <br />of a proposed use with the character of the adj g P P y <br />uses, and the district as a whole, or to protect such character. <br />4. The term of a conditional use permit issued sedhereinshow- <br />shall be indefinite and may be revoked only upon <br />ing that the site is not rmitgissued for <br />andtin authorize <br />in the conditional tional use p e <br />attached by the city council. <br />5. In approving or disapproving the application, the city <br />council shall adopt written findings detailing the reasons for its <br />action. <br />170.016D STANDARDS FOR CONS)DERATI0N <br />In making the determination of whether or not the conditional use <br />to be allowed, the city shall consider the following: <br />is <br />a. The nature of the land upon which the use is to be <br />located; <br />b. The nature of the adjoining land or buildings; <br />c . The proximity of a similar use; <br />d. The etfect upon traffic into and from the premises, <br />or on any adjoining roads; <br />e. The total number of similar uses within the city; <br />f. Whether or not the use will be dangerousworkother- <br />wise detrimental to persons residing or <br />in the vicinity of the use, or to the public wel- <br />fare, and whether or not it will substantially <br />impair the use, enjoyment or value of any property. <br />1.70.016E CRITERIA FOR APPROVAL <br />A conditional use shall be approved if and only if it is found to meet <br />- all of the following criteria: <br />establishment, maintenance or operation <br />not be detrimental to or endanger the public <br />h lth safety or general welfare and is not con- <br />1 <br />a.
