II. FRONT SETBACKS PREVAILING <br />Where adjoining structures existing at the time of adoption of this <br />chapter have a different setback from that required, the front setback <br />of a new structure shall conform to the prevailing setback in the <br />immediate vicinity. The zoning officer shall determine the necessary <br />front yard setback in such cases. In no case shall a building be <br />required to set back more than sixty (60) feet, except where a business <br />district is adjacent to a residential district. <br />III. SIDE AND REAR SETBACKS - PARTY WALLS <br />Buildings may be excluded from side and rear setback requirements if <br />party walls are used and if the adjacent buildings are constructed as <br />an integral structure. <br />IV. SETBACKS ADJACENT TO RESIDENTIAL AREAS <br />Where a retail business district is adjacent to or across the street <br />from a residential district, the minimum building setback from the <br />lot line and street facing the residential district shall be thirty - <br />five (35) feet. <br />j SETBACKS ALONG THOROUGHFARES <br />Along streets which are main throughfares or designated in the county's <br />thoroughfare plan, the minimum setback for all buildings and structures. <br />shall be one hundred ten (110) feet from the centerline of the street <br />or fifty (50) feet from the right -of -way line, whichever is the greater <br />setback, except where a service road exi'sts,in which case there shall <br />be a thirty -five (35) foot setback. <br />VI. HEIGHT REGULATIONS <br />• <br />No structure shall exceed thirty -five (35) feet in height above average <br />ground level unless approved by the zoning officer. The zoning officer <br />may authorize a variance to the height regulations in any district if: <br />a. All front, side, and rear yard depths of buildings <br />are increased one (1) foot for each additional foot <br />of height; or <br />b. The structure is any of the following: Television <br />and radio towers, church spires, belfries, monuments, <br />tanks, water and fire towers, grain elevators, stage <br />towers and scenery lofts, cooling towers, ornamental <br />towers and spires, chimneys, elevator bulkheads, <br />smokestacks, conveyors, flagpoles, silos, and air <br />conditioning and heating units. <br />Notwithstanding any provision of this section, or any other requirement <br />of this chapter, no structure shall be allowed to exceed in height the <br />effective fire protection height capability of the fire protection <br />provided by the City of Ramsey. <br />
