Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #23-050 A RESOLUTION APPROVING BOTH A DEVELOPMENT AGREEMENT AND STORMWATER MAINTENANCE AGREEMENT FOR THE PROPERTY GENERALLY KNOWN AS 6710 HIGHWAY 10 NW AND DECLARING TERMS OF SAME WHERAS, Reliable Auto Collision Experts, Inc., hereinafter referred to as the "Applicant" has had their Site Plan, Easement Vacation, and Conditional Use Permit approved for an automotive repair center on the property legally described as follows: Lots 1 & 3 Block 1 Riverside West Rearrangement, Anoka County, Minnesota (the "Subject Property"); and WHERAS, the Subject Property is zoned B-2 Business District, which is a commercial zoning designation and guided as such in the 2040 Comprehensive Plan; and WHERAS, the City Council reviewed and approved the Site Plan, Easement Vacation and Conditional Use Permit on September 13, 2022; and WHERAS, a contingency of approval for the Site Plan, Easement Vacation and Conditional Use Permit included the Applicant entering into a Development Agreement with the City; and WHERAS, the project requires a Stormwater Maintenance Agreement for the proposed pond on the east side of the Subject Property; and WHERAS, the City Council reviewed and approved the Development Agreement on March 14, 2023. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Ramsey City Council hereby grants approval of the Development Agreement and Stormwater Maintenance Agreement (the "Agreements") for Reliable Auto Collision Experts, Inc. (the "Applicant") at 6710 Highway 10 NW (the "Subject Property") contingent upon the following conditions: CONDITIONS 1. Final legal form approved by the City Attorney. 2. That the Applicant shall be responsible for all City costs incurred in administering and enforcing these Agreements.
