Councilmember Pearson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #06-02-053 <br /> <br />RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF <br />CERTAIN PROPERTY FOR DEVELOPMENT PURPOSES <br /> <br /> WHEREAS, the City of Ramsey ("City") is a municipal corporation and subdivision of <br />the State of Minnesota organized and operating under Minnesota law, and is authorized by Minn. <br />Stat. § 412.211, § 465.01, Ch. 469 and by its City Charter to acquire real estate by exercising the <br />power of eminent domain under and pursuant to Minn. Stat., Ch. 117; and <br /> <br /> WHEREAS, pursuant to Minn. Stat. Ch. 469, the City has the authority to establish <br />development districts, development projects and tax increment financing districts; and <br /> <br /> WHEREAS, the City Council properly adopted Development District No. I (the <br />"Development District") on August 27, 1985, and thereafter amended the Development District <br />on June 30, 1986; March 29, 1988; December 13, 1994; November 24, 1998; and October 23 <br />2001; and <br /> <br /> WHEREAS, the Amended and Restated Development Program for Development District <br />No. 1 was adopted on October 23, 2001; and <br /> <br /> WHEREAS, within the Development District, the City created T1F District No. 1 on August <br />27, 1985 (a redevelopment district); TIF District No. 2 on June 30, 1986 (a redevelopment district); TIF <br />District No. 4 on August 11, 1987 (a redevelopment district); TIF District No. 5 on April 24, 1990 (an <br />economic development dishfct); TIF District No. 6 on September 12, 1995 (an economic development <br />district); TIF District No. 7 on January 25, 2000 (a redevelopment district); and TIF District No. 8 on <br />December 12, 2000 (a redevelopment district); and TIF District No. 9 on October 23, 2001 (a <br />housing district); and TIF District No. 10 on October 23, 2001 (an economic development <br />district); and <br /> <br /> WHEREAS, the parcels of real estate listed in Exhibit A attached hereto and <br />incorporated herein ("Subject Property") are located within the Development District and are <br />among the parcels which may be acquired; and <br /> <br /> WHEREAS, the City Council has adopted its Development Program for the <br />Development District which provides that the future use of the Subject Property will be for <br />commercial/industrial development and related purposes; and <br /> <br /> WHEREAS, the City has performed all actions required by law to be performed prior to <br />the creation and amendment of the Development District, and adoption of the Development <br />Program and TIF Plan; and <br /> <br /> WHEREAS, the City Council finds that the Subject Property includes underutilized and <br />vacant land; and <br /> <br />JML-275247v 1 <br />RAI25~5 <br /> <br /> <br />
