City Engineer Jankowski explained the City received a request on October 7, 2005 from Karla <br />Weiss requesting the removal of a stormwater drainage pond from her property located at 5907 <br />151st Lane. Mrs. Weiss is concerned about the presence of the pond as a potential safety hazard. <br />This pond has been a part of the drainage plan for the area since being developed in 1989 as a <br />part of the Haubrich subdivision. The ponding area is covered with a drainage and utility <br />easement. The City currently has approximately 90 such ponds in place to receive and treat <br />stormwater prior to discharge to natural wetlands and streams. He advised staff recommends <br />denial of this request. Mrs. Weiss has requested the opportunity to address the Public Works <br />Committee. <br /> <br />Chris Weiss, 5907 151st Lane, stated they are open to suggesiions on this project. If the pond <br />cannot be removed they would like to look at an outlet being provided because every time there <br />is a rain of ½ inch or more there is flooding with everyone's debris ending up in their yard. They <br />are also concerned there will be an addition to the east of them, and they are concerned about <br />what will happen when the landscaping of the land begins to change. He has talked to the City <br />Attorney and is trying to get an answer about whose liability it would be if a child were to <br />wander into the pond. The City Attorney has informed him if they were to invite children to <br />their property it would be under their insurance. He stated this should be identified as not being <br />their liability because they did not put the pond there. <br /> <br />City Engineer Jankowski explained the water reaches a certain elevation and flo~vs overland <br />along the rear of the lots to the wetland. Several years ago there was work done to ensure some <br />high spots were shaved down to ensure that the Weiss residence remains dry. He indicated he <br />was at the Weiss property after the recent heavy rains and the water was quite a ways away from <br />the residence. If staff needs to visit the site again to be sure there is sufficient head to move the <br />water into the wetland they are willing to do that. <br /> <br />Chairperson Cook asked if this is a sediment pond. <br /> <br />Assistant Public Works Director Olson responded in the affirmative. He indicated the pond was <br />approved prior to the house being built and it also serves as rate control. <br /> <br />City Engineer Jankowski explained the drainage easement was planned as part of the Haubrich <br />Addition, and at that time the configuration of the street required that the water follow this route. <br /> <br />Chairperson Cook inquired if the pond is located on City property. <br /> <br />City Engineer Jankowski replied the pond is located on a drainage and utility easement. <br /> <br />Chairperson Cook inquired if the drainage easement is part of several lots. <br /> <br />City Engineer Jankowski responded in the affirmative. He explained the lot was re-subdivided <br />with the Juskowitz Addition and the drainage easement remained in place. <br /> <br />Councilmember Olson inquired if development of the land to the east of this would change the <br />contour of the land and route more water into the pond. <br /> <br />Public Works Committee / October 18, 2005 <br /> Page 2 of 7 <br /> <br /> <br />
