City Code Compliance. The CITY approves the Plat conditioned on the DEVELOPER <br />developing the Plat in accordance with the applicable provisions of City Code, Section 9.50, <br />entitled Subdivision. <br /> <br />2. Conformance with Plan. The Plat shall be developed pursuant to the Final Plat Plan, <br /> Utility Plans; Sanitary Sewer and Watermain Construction; Storm Sewer and Street <br /> Construction; Grading, Erosion Control and Details; Landscape Plan and Tree Inventory; <br /> dated February 2, 2006, prepared by Passe Engineering. <br /> <br />3. Incorporation of All City Code Requirements. That the recitals above and the applicable <br /> provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br /> Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br /> <br />4. Stage I Improvements Required. The ~nprQvements the CITY requires the <br /> DEVELOPER to construct within the Plat are'as follows:~ <br /> <br />no <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Streets with concrete curb and gutter <br />Trunk and lateral storm drainage facilities <br />Lot grading and permanent erosion control <br />Sidewalk Construction along Limonite Street N.W., I67th Terrace N.W., Olivine <br />Street N.W., 170th Trail N.W. <br />Trail construction along the Trott Brook corridor from the western boundary of <br />the plat to CSAH 5 <br />Natural gas <br />Telephone service <br />Electric service <br />Street lights (installment arranged by CITY during Stage [ Improvements and <br />paid for by DEVELOPER as Stage II Improvement) <br /> <br />("Stage I Improvements") <br /> <br />Th~ DEVELOPER agrees to construct the Stage I Improvements accordIng to the terms and <br />conditions of this agreement and in accordance with DEVELOPERS' plans submitted to the <br />CITY: Utility Plans; Sanitary Sewer and Watermain Construction; Storm Sewer and Street <br />Construction; Grading, Erosion Control and Details, dated February 2, 2006, prepared by <br />Passe Engineering. The final construction plan for the Stage I Improvements shall be <br />submitted to the City Engineer for review and approval prior to commencement of <br />construction. <br /> <br />The DEVELOPER shall be responsible for completing the rough grading and providing lot <br />corner stakes prior to the installation of underground utilities.
