Minimum Required Lot Width in the Mississippi River Overlay District. <br />Minimum lot widths are as approved by the PUD. <br /> <br />9.21.12 Setbacks <br /> <br /> Subd. 1. Minimum Required Structure Setbacks in Mississippi River Overlay District. <br />The minimum required setbacks for any structure located within the Mississippi River Overlay <br />District shall meet the minimum requirements for the particular base zoning district in which said <br />structure is located (see City's Zoning Code) and in addition thereto, said structure shall meet the <br />following requirements: <br /> <br />No public street right-of-way boundary shall be within 100 feet of the ordinary <br />high water mark of the river. ' · <br /> <br />Except for structures located on platted lots of record as of [effective date of <br />ordinance], no residential structure (primary or accessory) shall be within 100 <br />feet of the OHWL and within 35 feet of the bluffiine. <br /> <br />On-site sewage disposal systems shall be located at least 75 feet from the OHWL <br />of the river. <br /> <br />d. Exceptions to the requirements of paragraphs 1), 2) and 3) above are: <br /> <br />to <br /> <br />Public safety facilities, public bridges and their roadway approaches, railroad <br />sidings, minor public and private roadways servicing water related uses on <br />the riverfront; <br /> <br />Approved river crossings of essential services and essential service <br />distribution systems which are primarily underground except for terminal and <br />metering devices not exceeding 6 feet in height and supporting structures for <br />transmission crossing spans. <br /> <br />3. Approved transportation river crossings. <br /> <br />4. The construction of above-ground pumping stations for sewer lines which <br /> shall be screened from view of the river. <br /> <br />9.21.13 <br /> <br />Structure Heights <br /> <br /> Subd. 1. Maximum Permitted Heights of Structures in Mississippi River Overlay <br />District. The maximum permitted height for any structure located within the Mississippi River <br />Overlay District shall meet the maximum requirements for the particular base zoning district in <br />which it is located (see City's Zoning Ordinance) and in addition thereto, said structure shall meet <br />the following requirements: <br /> <br />New structures and additions to existing structures shall be limited to a maximum <br />height of 35 feet; <br /> <br />-203- <br /> <br /> <br />
