platting will create public roadway access to the site and therefore this easement may be <br />temporary. <br />21. Grading on CITY property. The PERMITTEE will be grading on a portion of Lot 1, <br />Block 6 (Park Dedication Area) after it is deeded to the CITY. A separate temporary <br />grading agreement shall be required. <br />22. The Park Dedication Area shall be free of junk and debris. All structures to include the <br />house, barn, and outbuildings shall be reasonably intact, secure, and complete, and will be <br />empty and clean, free of any furniture, junk, debris, or the like. <br />23. Requirements for Building and Occupancy Permits. <br />a. No building permit for any lot in the Plat shall be issued until the PERMITTEE <br />has: (a) provided the CITY Building Official with a Certificate of Survey; (b) the <br />financial guaranty described in Section 12 to the CITY; and (c) obtained all <br />necessary permits from the Lower Rum River Watershed Management <br />Organization and has provided a copy of such permit to the CITY. <br />b. No occupancy permit for any lot in the Plat shall be issued until the PERMITTEE <br />has: (a) constructed vehicular access to the lot, including the installation of at least <br />one layer of bituminous surfacing; (b) constructed all utilities and storm water <br />facilities this Agreement requires to serve the lot and such utilities and storm water <br />facilities are in place, operational and accepted by the CITY; (c) for lots that have <br />a slope of less than 2%, provided the CITY with a certificate of grading, prepared <br />by a licensed (State of Minnesota) professional land surveyor, certifying that the <br />flattest grade on the lot is 1 % or greater; and (d) installed and planted the boulevard <br />sod and landscaping that are required as a part of the Stage I Improvements, <br />weather permitting. <br />C. Model Home Permits. Model homes shall be located on Lots 2, 31 41 5, and 6, <br />Block 1. Building permits for the model homes shall not be issued until after <br />sanitary sewer services are available to each lot and are subject to standard building <br />permit review by the CITY's Building Inspections Division. The following <br />conditions apply: <br />i. No parking loading, unloading, or staging of any vehicles, equipment, or <br />materials is allowed on Variolite Street NW or any existing residential <br />street to the west. <br />ii. If there are any conflicts between the activities of the homebuilder and the <br />street/utility contractor, the street/utility contractor shall be given priority. <br />iii. The CITY's building inspectors shall have access to each home for normal <br />scheduled inspections. If access is not provided, the PERMITTEE shall <br />forfeit the inspection and pay the normal reinspection fee. <br />iv. Model homes will not be open to the public until water and sanitary sewer <br />(with the exception of the lift station) are operational to each model home <br />and 1701h Avenue NW and Uranimite Street NW have the base course of <br />pavement installed. The PERMITTEE may provide portable restrooms in <br />lieu of operational water and sanitary sewer. <br />V. Temporary driveways must be removed and ditches restored. <br />G <br />
