CC Regular Session 5.5. <br />Meeting Date: 03/28/2023 <br />By: Todd Larson, Community Development <br />Information <br />Title <br />Adopt Resolution #23-058 Declaring Development Agreement Satisfied and Authorizing Release from Property - <br />Lord of Life Church <br />Purpose/Background: <br />Lord of Life Church at 14501 Nowthen Blvd. NW is comprised of property that has been subdivided multiple <br />times over the years. Portions of the property are still encumbered by development agreements that are not <br />associated with the Church itself. The western portion of the property was once a remnant outlot from the <br />early-1990s Sunny Ponds residential subdivision to the northwest. In 2012, Lord of Life sold the southern <br />portion of their property for development of the Stoney River senior living complex. These two development <br />agreements are showing up on the Church's property title. <br />The Church is working with Presbyterian Homes on developing portions of the site for senior living and <br />multi -family buildings. Cleaning up the title is just one of many steps for that project. It is not uncommon for <br />property owners to request releases from satisfied development agreements or expired conditional use permits, <br />especially when a property sale is anticipated. The property owner records the resolution approving the release <br />against the property with the Anoka County Recorder's office. <br />The City Council approved the release of Sunny Ponds agreement on February 14. The other development, <br />Stoney River, however, still needs as -built civil plans submitted to be truly completed. The proposed resolution <br />does not release the agreements from the Stoney River property as that owner is still responsible for producing the <br />documents. The attached resolution acknowledges that there are no further obligations needed from the Lord of <br />Life property. Staff has reached out to Stoney River's design team for the needed documents without avail. <br />Notification: <br />None required. <br />Funding Source: <br />This request is being done as a normal part of staff s duties. Recording costs are the responsibility of the property <br />owner. <br />Recommendation: <br />Staff recommends approval of the resolution. <br />Action: <br />Motion to waive the City Charter provision of reading a resolution aloud and adopt Resolution #23-058 Declaring <br />Development Agreement Partially Satisfied and Authorizing Release from Property. <br />Attachments <br />Request Letter <br />ACTION - Resolution #23-058 <br />
