Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #23-058 <br />RESOLUTION DECLARING DEVELOPMENT AGREEMENT PARTIALLY <br />SATISFIED AND AUTHORIZING RELEASE FROM PROPERTY <br />WHEREAS, Lord of Life Church, hereafter referred to as "Property Owner", requested a <br />release from a development agreement associated with the following described property located <br />in the City of Ramsey: <br />Lot 1, Block 1, Stoney River Addition, except road and subject to easements of <br />record, Anoka County, Minnesota <br />(the ` Subj ect Property'); and <br />WHEREAS, the Subject Property is encumbered, in whole or in part, by the following <br />development agreement (the "Development Agreement") for a past project: <br />"City of Ramsey Development Contract for Stoney River" recorded as Document <br />Number 2037549.007 (record ID 2522288) on August 21, 2012. <br />WHEREAS, the project that is the subject of that Development Agreement have not been <br />completed to the terms therein; and <br />WHEREAS, the project's outstanding obligations that are noted within the Development <br />Agreement are not relevant to the Property Owner nor the Subject Property; and <br />WHEREAS, the City is declaring the Development Agreement satisfied in respect with <br />the Subject Property described above only; and <br />WHEREAS, the Development Agreement will remain on the title affected property; and <br />WHEREAS, the City Council reviewed request to release this Development Agreement <br />from the Subject Property on March 28, 2023. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />The Development Agreement referenced above is deemed satisfied on the Subject Property and <br />may be released only from the Subject Property described above. <br />
