HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />182.1 (4) the person conspires with or employs a person under the age of 18 to unlawfully sell <br />182.2 one or more mixtures containing a controlled substance listed in Schedule I, II, or III, except <br />182.3 a Schedule I or II narcotic drug. <br />182.4 <br />182.5 <br />182.6 <br />182.7 EFFECTIVE DATE. This section is effective January 1, 2024, and applies to crimes <br />182.8 committed on or after that date. <br />182.9 Sec. 14. Minnesota Statutes 2022, section 152.023, subdivision 2, is amended to read: <br />182.10 Subd. 2. Possession crimes. (a) A person is guilty of controlled substance crime in the <br />182.11 third degree if <br />182.12 (1) on one or more occasions within a 90-day period the person unlawfully possesses <br />182.13 one or more mixtures of a total weight of ten grams or more containing a narcotic drug other <br />182.14 than heroin; <br />182.15 (2) on one or more occasions within a 90-day period the person unlawfully possesses <br />182.16 one or more mixtures of a total weight of three grams or more containing heroin; <br />182.17 (3) on one or more occasions within a 90-day period the person unlawfully possesses <br />182.18 one or more mixtures containing a narcotic drug, it is packaged in dosage units, and equals <br />182.19 50 or more dosage units; <br />182.20 (4) on one or more occasions within a 90-day period the person unlawfully possesses <br />182.21 any amount of a schedule I or II narcotic drug or five or more dosage units of lysergic acid <br />182.22 diethylamide (LSD), 3,4-methylenedioxy amphetamine, or <br />182.23 3,4-methylenedioxymethamphetamine in a school zone, a park zone, a public housing zone, <br />182.24 or a drug treatment facility; <br />182.25 (5) on one or more occasions within a 90-day period the person unlawfully possesses <br />182.26 <br />182.27 . <br />182.28 (i) more than ten kilograms of cannabis flower; <br />182.29 (ii) more than two kilograms of cannabis concentrate; or <br />182.30 (iii) edible cannabis products, lower -potency hemp edibles, hemp -derived consumer <br />182.31 products, or any combination of those infused with more than 200 grams of <br />182.32 tetrahydrocannabinol; or <br />Article 4 Sec. 14. 182 <br />
