HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />213.1 and send a letter to the last known address of the person whose offense has been expunged <br />213.2 identifying each agency to which the order was sent. <br />213.3 (e) Data on the person whose offense has been expunged in a letter sent under this <br />213.4 subdivision are private data on individuals as defined in section 13.02. <br />213.5 Subd. 11. Resentencing. (a) If the Cannabis Expungement Board determined that a <br />213.6 person is eligible for resentencing to a lesser offense and the person is currently under <br />213.7 sentence. the court shall broceed as if the abDellate court directed a reduction of the conviction <br />213.8 to an offense of lesser degree pursuant to rule 28.02, subdivision 12 of the Rules of Criminal <br />213.9 Procedure. <br />213.10 (b) If the Cannabis Expungement Board determined that a person is eligible for <br />213.11 resentencing to a lesser offense and the person completed or has been discharged from the <br />213.12 sentence, the court may issue an order amending the conviction to an offense of lesser degree <br />213.13 without holding a hearing. <br />213.14 (c) If the Cannabis Expungement Board determined that there is Lyood cause to restore <br />213.15 the person's right to possess firearms and ammunition, the court shall, as necessary, issue <br />213.16 an order pursuant to section 609.165, subdivision Id. <br />213.17 EFFECTIVE DATE. This section is effective August 1, 2023. <br />213.18 <br />ARTICLE 6 <br />213.19 MISCELLANEOUS PROVISIONS <br />213.20 Section 1. [3.9224] MEDICAL CANNABIS; COMPACTS TO BE NEGOTIATED. <br />213.21 Subdivision 1. Definitions. (a) As used in this section, the following terms have the <br />213.22 meanings given. <br />213.23 (b) "Indian Tribe" means a Tribe, band, nation, or other federally recognized group or <br />213.24 community of Indians located within the geographical boundaries of the state of Minnesota. <br />213.25 (c) "Medical cannabinoid product" has the meaning given in section 342.01, subdivision <br />213.26 50. <br />213.27 (d) "Medical cannabis flower" has the meaning given in section 342.01, subdivision 52. <br />213.28 Subd. 2. Negotiations authorized. Following a public hearing, the governor or the <br />213.29 governor's designated representatives are authorized to negotiate in good faith a compact <br />213.30 with an Indian Tribe regulating medical cannabis flower and medical cannabinoid products. <br />213.31 The attorney general is the legal counsel for the governor or the governor's representatives <br />Article 6 Section 1. 213 <br />
