Minnesota Statutes 2022, section 181.957, subdivision 1, is amended to read: <br />235.4 Subdivision 1. Excluded employees and job applicants. Except as provided under <br />235.5 subdivision 2, the employee and job applicant protections provided under sections 181.950 <br />235.6 to 181.956 do not apply to employees and job applicants where the specific work performed <br />235.7 requires those employees and job applicants to be subject to drug and alcohol testing or <br />235.8 cannabis testing pursuant to: <br />235.9 (1) federal regulations that specifically preempt state regulation of drug and alcohol <br />235.10 testing or cannabis testing with respect to those employees and job applicants; <br />235.11 (2) federal regulations or requirements necessary to operate federally regulated facilities; <br />235.12 (3) federal contracts where the drug and alcohol testing or cannabis testing is conducted <br />235.13 for security, safety, or protection of sensitive or proprietary data; or <br />235.14 (4) state agency rules that adopt federal regulations applicable to the interstate component <br />235.15 of a federally regulated industry, and the adoption of those rules is for the purpose of <br />235.16 conforming the nonfederally regulated intrastate component of the industry to identical <br />235.17 regulation. <br />235.18 Sec. 29. Minnesota Statutes 2022, section 245C.08, subdivision 1, is amended to read: <br />235.19 Subdivision 1. Background studies conducted by Department of Human Services. (a) <br />235.2o For a background study conducted by the Department of Human Services, the commissioner <br />235.21 shall review: <br />235.22 (1) information related to names of substantiated perpetrators of maltreatment of <br />235.23 vulnerable adults that has been received by the commissioner as required under section <br />235.24 626.557, subdivision 9c, paragraph 0); <br />235.25 (2) the commissioner's records relating to the maltreatment of minors in licensed <br />235.26 programs, and from findings of maltreatment of minors as indicated through the social <br />235.27 service information system; <br />235.28 (3) information from juvenile courts as required in subdivision 4 for individuals listed <br />235.29 in section 245C.03, subdivision 1, paragraph (a), when there is reasonable cause; <br />Article 6 Sec. 29. 235 <br />
