HF100 NINTH ENGROSSMENT REVISOR BD 110100-9 <br />239.1 from the Centers for Medicare and Medicaid Services (CMS) that a rebate agreement was <br />239.2 not signed. <br />239.3 Sec. 32. Minnesota Statutes 2022, section 256D.024, subdivision 1, is amended to read: <br />239.4 Subdivision 1. Person convicted of drug offenses. (a) If an applicant or recipient has <br />239.5 been convicted of a drug offense after July 1, 1997, except for convictions related to cannabis, <br />239.6 marijuana, or tetrahydrocannabinols, the assistance unit is ineligible for benefits under this <br />239.7 chapter until five years after the applicant has completed terms of the court -ordered sentence, <br />239.8 unless the person is participating in a drug treatment program, has successfully completed <br />239.9 a drug treatment program, or has been assessed by the county and determined not to be in <br />239. i o need of a drug treatment program. Persons subject to the limitations of this subdivision who <br />239.11 become eligible for assistance under this chapter shall be subject to random drug testing as <br />239.12 a condition of continued eligibility and shall lose eligibility for benefits for five years <br />239.13 beginning the month following: <br />239.14 (1) any positive test result for an illegal controlled substance under chapter 152; or <br />239.15 (2) discharge of sentence after conviction for another drug felony. <br />239.16 (b) For the purposes of this subdivision, "drug offense" means a conviction that occurred <br />239.17 after July 1, 1997, of sections 152.021 to 152.025, 152.0261, 152.0262, or 152.096. Drug <br />239.18 offense also means a conviction in another jurisdiction of the possession, use, or distribution <br />239.19 of a controlled substance, or conspiracy to commit any of these offenses, if the offense <br />239.20 occurred after July 1, 1997, and the conviction is , <br />239.21 for a crime that would be a felony if committed <br />239.22 in Minnesota. <br />239.23 Sec. 33. Minnesota Statutes 2022, section 256D.024, subdivision 3, is amended to read: <br />239.24 Subd. 3. Fleeing felons. An individual who is fleeing to avoid prosecution, or custody, <br />239.25 or confinement after conviction for a crime that <br />239.26 , ,would <br />239.27 be a felony if committed in Minnesota, is ineligible to receive benefits under this chapter. <br />239.28 Sec. 34. Minnesota Statutes 2022, section 256J.26, subdivision 1, is amended to read: <br />239.29 Subdivision 1. Person convicted of drug offenses. (a) An individual who has been <br />239.30 convicted of a felony level drug offense committed during the previous ten years from the <br />239.31 date of application or recertification, except for convictions related to cannabis, marijuana, <br />239.32 or tetrahydrocannabinols, is subject to the following: <br />Article 6 Sec. 34. 239 <br />
