HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />251.1 (b) Failure of the sheriff to notify the applicant of the denial of the application within <br />251.2 30 days after the date of receipt of the application packet constitutes issuance of the permit <br />251.3 to carry and the sheriff must promptly fulfill the requirements under paragraph (c). To deny <br />251.4 the application, the sheriff must provide the applicant with written notification and the <br />251.5 specific factual basis justifying the denial under paragraph (a), clause (2) or (3), including <br />251.6 the source of the factual basis. The sheriff must inform the applicant of the applicant's right <br />251.E to submit, within 20 business days, any additional documentation relating to the propriety <br />251.8 of the denial. Upon receiving any additional documentation, the sheriff must reconsider the <br />251.9 denial and inform the applicant within 15 business days of the result of the reconsideration. <br />251. i o Any denial after reconsideration must be in the same form and substance as the original <br />251.11 denial and must specifically address any continued deficiencies in light of the additional <br />251.12 documentation submitted by the applicant. The applicant must be informed of the right to <br />251.13 seek de novo review of the denial as provided in subdivision 12. <br />251.14 (c) Upon issuing a permit to carry, the sheriff must provide a laminated permit card to <br />251.15 the applicant by first class mail unless personal delivery has been made. Within five business <br />251.16 days, the sheriff must submit the information specified in subdivision 7, paragraph (a), to <br />251.17 the commissioner for inclusion solely in the database required under subdivision 15, <br />251.18 paragraph (a). The sheriff must transmit the information in a manner and format prescribed <br />251. i 9 by the commissioner. <br />251.20 (d) Within five business days of learning that a permit to carry has been suspended or <br />251.21 revoked, the sheriff must submit information to the commissioner regarding the suspension <br />251.22 or revocation for inclusion solely in the databases required or permitted under subdivision <br />251.23 15. <br />251.24 (e) Notwithstanding paragraphs (a) and (b), the sheriff may suspend the application <br />251.25 process if a charge is pending against the applicant that, if resulting in conviction, will <br />251.26 prohibit the applicant from possessing a firearm. <br />251.27 (f) A sheriff shall not deny an application for a permit to carry solely because the applicant <br />251.28 is a patient enrolled in the registry program and uses medical cannabis flower or medical <br />251.29 cannabinoid products for a qualifying medical condition or because the person is 21 years <br />251.30 of age or older and uses adult -use cannabis flower, adult -use cannabis products, <br />251.31 lower -potency hemp edibles, or hemp -derived consumer products. <br />251.32 Sec. 54. Minnesota Statutes 2022, section 624.7142, subdivision I. is amended to read: <br />251.33 Subdivision 1. Acts prohibited.
