1 Covenant means a contract between two individuals which constitutes a restriction of a particular use of <br />2 land that is not enforced by the City, County, State, or Federal government. <br />3 Conventional subdivision. A pattern of subdivision that is characterized by lots that are spread regularly <br />4 throughout a parcel in a lot and block design. <br />5 Data Center means a facility that houses information technology (IT) infrastructure for building, running, <br />6 and delivering applications and services and for storing and managing the data associated with <br />7 those applications and services. <br />8 Daycare Centers means a licensed business that provides supervision of and care for children, physically <br />9 or mentally disabled adults, or the elderly for a portion of the day or night. <br />10 Deck. A horizontal, unenclosed, aboveground level structure open to the sky, with or without attached <br />11 railings, seats, trellises, or other features, attached or functionally related to a principal use or site. <br />12 Density means a number expressing the ratio of dwelling units to an acre of land. Net Density deducts <br />13 waterbodies and wetlands. <br />14 Detailing services means a business that provide comprehensive cleaning and reconditioning of both a <br />15 vehicle's interior and exterior. <br />16 Developer. Having the meaning given under Minn. Stats. § 116G.03. <br />17 Development. Having the meaning given under Minn. Stats. § 116G.03. <br />18 Discharge means the conveyance, channeling, runoff, or drainage, of stormwater, including snowmelt, <br />19 from a GeRStFU Gtier site. <br />20 Discretionary action. An action under this chapter related to land use that requires a public hearing by <br />21 local ordinance or statute, such as preliminary plats, final subdivision plats, planned unit <br />22 developments, conditional use permits, interim use permits, variances, appeals, and rezonings. <br />23 Distribution Facility means an establishment where shipments of tangible personal property are <br />24 processed for delivery to customers. <br />25 Dock. Having the meaning given under Minnesota Rules, chapter 6115. <br />26 Driveway means an onsite prepared surface traffic lane, which shall be the traffic lane leading directly <br />27 from a public street to the primary garage or a parking pad or lot on the subject parcel; <br />28 Dustless Surface consists of compacted bituminous millings or crushed rock. The crushed rock must all be <br />29 similar in size with no fine particles. Aggregate material similar to state DOT class 5 is not considered <br />30 dustless. <br />31 Dwelling, manufactured home, means a structure, transportable in one or more sections, which in the <br />32 traveling mode, is eight body feet or more in width and 40 body feet or more in length, or, when <br />33 erected on site, is 320 or more square feet, and which is built on a permanent chassis and designated <br />34 to be used as a dwelling with or without a permanent foundation when connected to the required <br />35 utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained <br />36 therein; except that the term includes any structure which meets all the requirements and with <br />37 respect to which the manufacturer voluntarily files a certification pursuant to Minn. Stats. §§ <br />38 327.31-327.36. The term "dwelling, manufactured home," does not include "recreational vehicle" <br />39 as defined herein. <br />40 Dwelling, multiple family, means a building designed with three or more dwelling units exclusively for <br />41 occupancy by three or more families living independently of each other but sharing hallways and <br />42 main entrances and exits. <br />43 Dwelling, senior living, means a building designed with three or more dwelling units exclusively for <br />44 occupancy where at least one of the residents in each unit is aged 55 or greater living independently <br />45 of each other but sharing hallways and main entrances and exits. <br />46 Dwelling, single-family detached, means a dwelling unit designed exclusively for occupancy by one family. <br />47 , <br />48 ' <br />49 . <br />Page 8 of 147 <br />
