1 (D) Term of GenditienG interim use permit for personal use heliport. Conditional Interim use permits for <br />2 personal use heliports shall be temporary in nature and shall be granted to a designated person <br />3 who either resides on the property or has written permission from the property owner to utilize the <br />4 property for a heliport. Permits are not transferable from person to person or from address to <br />5 address. <br />6 (E) Termination of permit. The use is not initiated within 12 months of the date of city council approval; or <br />14 b. The permit is discontinued for a continuous 12-month period; unless a written request <br />15 for an extension of time has been received and approved by the city council prior to the <br />16 expiration of the original permit. <br />17 <br />18 <br />19 350 Tree Preservation <br />20 <br />21 <br />22 360 Signs (could be split to the different sections below) <br />23 <br />24 <br />25 370 Communications Towers <br />26 (A) Purpose. In order to accommodate the communication needs of residents and business while <br />27 protecting the public health, safety, and general welfare of the community, the council finds that <br />28 these regulations are necessary in order to: <br />29 (1) Facilitate the provision of wireless telecommunication services to the residents and <br />30 businesses of the city; <br />31 (2) Minimize adverse visual effects of towers through careful design and siting standards; <br />32 (3) Avoid potential damage to adjacent properties from tower failure through structural <br />33 standards and setback requirements; and <br />34 (4) Maximize the use of existing and approved towers and buildings to accommodate new <br />35 wireless telecommunication antennas in order to reduce the number of towers needed to <br />36 serve the community. <br />37 (B) Towers in residential zoning districts. Construction of towers to support commercial antennas that <br />38 conform to all applicable provisions of this Code may be allowed only the following locations: <br />39 (1) Parcels within the Tower Overlay District as shown on the official zoning map. <br />40 (2) All ehWeh religious institution, government, school, utility, and institutional sites <br />41 (3) If the proposed tower is to be located within a residential district, documentation must be <br />42 included in the application that demonstrates that the tower cannot be reasonably located <br />43 within a commercial, industrial, or public/quasi-public zoning district. <br />44 C) Towers in COR and Mississippi River Corridor Critical Area Overlay Zoning Districts. Construction of <br />45 towers to support commercial antennas shall not be allowed in Town Center and Critical River <br />46 Overlay Zoning Districts, except that antennas may be attached to existing structures provided the <br />47 antenna does not extend more than 20 feet above the highest point of the structure or tower. <br />Page 43 of 147 <br />
