Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #23-050 <br /> <br />RESOLUTION APPROVING BOTH A DEVELOPMENT AGREEMENT AND <br />STORMWATER MAINTENANCE AGREEMENT FOR THE PROPERTY <br />GENERALLY KNOWN AS 6710 HIGHWAY 10 NW AND DECLARING TERMS OF <br />SAME <br /> <br /> WHERAS, Reliable Auto Collision Experts, Inc., hereinafter referred to as the <br />“Applicant” has had their Site Plan, Easement Vacation, and Conditional Use Permit approved <br />for an automotive repair center on the property legally described as follows: <br /> <br />Lots 1 & 3 Block 1 Riverside West Rearrangement, Anoka County, Minnesota (the “Subject <br />Property”); and <br /> <br /> WHERAS, the Subject Property is zoned B-2 Business District, which is a <br />commercial zoning designation and guided as such in the 2040 Comprehensive Plan; and <br /> <br /> WHERAS, the City Council reviewed and approved the Site Plan, Easement Vacation <br />and Conditional Use Permit on September 13, 2022; and <br /> <br /> WHERAS, a contingency of approval for the Site Plan, Easement Vacation and <br />Conditional Use Permit included the Applicant entering into a Development Agreement with the <br />City; and <br /> <br /> WHERAS, the project requires a Stormwater Maintenance Agreement for the proposed <br />pond on the east side of the Subject Property; and <br /> <br /> WHERAS, the City Council reviewed and approved the Development Agreement on <br />March 14, 2023. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) That the Ramsey City Council hereby grants approval of the Development Agreement <br />and Stormwater Maintenance Agreement (the “Agreements”) for Reliable Auto <br />Collision Experts, Inc. (the “Applicant”) at 6710 Highway 10 NW (the “Subject <br />Property”) contingent upon the following conditions: <br /> <br />CONDITIONS <br /> <br />1. Final legal form approved by the City Attorney. <br /> <br />2. That the Applicant shall be responsible for all City costs incurred in administering and <br />enforcing these Agreements. <br />
