Chairperson Nixt stated that as to the density being pushed to the center, he is okay with that. He
indicated he likes the homeowner's park and community space.

Commissioner Van Scoy asked if the single-family homes are part of the Homeowner's
Association.

Ms. Goodroad stated they are part of the association. She indicated that the entire development
will be able to take advantage of the Homeowner's park.

Chairperson Nixt asked if the identified ponds are infiltration ponds or if they will be full and
maintained.

Ms. Goodroad stated they are intended to be full.

Chairperson Nixt asked if there are any drainage issues.

Civil Engineer II, Linton indicated that there are items pointed out in the Staff Review Letter.

Ms. Goodroad stated that they met with Staff yesterday and agreed to all the changes as they
proceed through the process.

Motion by Commissioner Johnson, seconded by Commissioner Van Scoy, to recommend City
Council adopt a Resolution approving Findings of Fact.

Commissioner Johnson indicated he has more problems with this as they get away from the
Town Center, but they are dealing with getting development by Highway 10. He stated as much
as it will interfere with his morning drive, he thinks it makes sense.

Commissioner Van Scoy agreed. He stated if the developer went strictly with the zoning that
was there they would be at about the same density, and they are really just looking for flexibility.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Van Scoy, Levine,
and Watson. Voting No: Commissioner Bmuer. Absent: Commissioner Shepherd.

Motion by Commissioner Johnson, seconded by Commissioner Van Scoy to recommend City
Council introduce the Ordinance to rezone the property from R-1 Single Family, R-2 Medium
Density Residential, and R-3 High Density Residential to Planned Unit Development.

Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Van Scoy, Levine,
and Watson. Voting No: Commissioner Brauer. Absent: Commissioner Shepherd.

Commissioner Brauer stated that he has a problem with the northwest comer, and if they are
going to change it he would rather it was done now before this goes further.

Planning Commission/October 6, 2005
