Absent: Commissioner Shepherd. <br /> <br />Case #11 <br /> <br />Consider Ordinance to Amend Sections 9.11 (Performance Standards) of <br />City Code; Case of City of Ramsey <br /> <br />Presentation <br /> <br />Associate Planner Dalnes advised that the proposed code amendment would establish minimum <br />standards for exterior solid fuel-fired heating devices including both a minimum setback from <br />property lines and installation requirements. She indicated that these requirements aim to <br />minimize the potential nuisances created by these appliances such as smoke and/or cinders. <br /> <br />Associate Planner Dalnes stated that at the September I, 2005 Planning Commission meeting, <br />City Staff presented a draft ordinance regarding exterior solid fuel-fired heating devices. She <br />indicated that after some discussion, Staff was directed to make some revisions to the proposed <br />regulations and bring the draft ordinance back to the Planning Commission for review. <br /> <br />Associate Planner Dalnes reviewed some of the changes, noting that a minimum property size <br />required to install a solid fuel-fired heating device has been eliminated, however, the setback <br />from any property line has been increased from fifty feet to seventy-five feet. She stated the <br />distance from a property line seems to be the factor that will contribute most to minimizing or <br />eliminating possible nuisances to neighboring properties as a result of excessive smoke and/or <br />cinders. <br /> <br />Community Development Director Trudgeon advised that this ordinance came about because <br />Staff received an application, and did not know what to do with it. He stated they decided there <br />should be an ordinance in case they receive more applications. <br /> <br />Commissioner Van Scoy noted there was a comment about a third party in the original wording. <br /> <br />Associate Planner Dalnes stated that has been replaced with "listed and labeled by a nationally <br />recognized testing laboratory". <br /> <br />Motion by Commissioner Levine, seconded by Commissioner Van Scoy, to recommend that City <br />Council adopt an ordinance to amend City Code Section 9. I 1 to establish regulations for exterior <br />solid fuel fired heating devices. <br /> <br />Commissioner Brauer suggested changing external to exterior in two places of Section 9.11.14 <br />for consistency. That change was included in the motion by the motion maker and the seconder. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Levine, Van Scoy, Brauer, <br />Johnson, and Watson. Voting No: None.
