SECOND A~NDMENT TO GRANT AGREEMENT BETWEEN THE METROPOLITAN COUNCIL AND THE CITY OF RAMSEY Contract No. 7R1Q0 Long-Term Extension WHEREAS, the Metropolitan Council, hereinafter referred to as the , hereinafter referred to "Council," and the as the "Grantee" hav~ p~eviously %ntered into a grant agreement for a local planning assistance grant, Metropolitan Council Contract No.78100 dated February 15 , 19 79., and amended on May 28 , 1979 .; and WHEREAS, the Grantee has agreed to prepare and adopt a comprehensive plan and the implementing official controls required of the Grantee by the Metropolitan Land Planning Act 473.851-473.872, as set forth in the Grantee's amended Appendix A; and WHEREAS, the agreement specifies that the grant funds are to be used by the Grantee according to the schedule set forth in amended Appendix B; and WHEREAS, the Grantee was to have submitted its comprehensive plan to the Council on or before July 1, 1980; and '~{HEREAS, the Grantee has requested a time extension for submitting its comprehensive plan, as permitted by Minnesota Statutes 473.869; and WHEREAS, the Council has authorized a time extension for the Grantee until April 1 , 1981, to submit its comprehensive plan under the condition that the Grantee amend the above-referenced agreement to reflect the revised due date for submission. NOW THEREFORE, the parties hereto agree that the. above-referenced agreement shall be amended in the following particulars: 1. Paragraph 5A is amended to read as follows: A. Duration. The period of grant award specified herein shall commence upon the execution of this agreement, and remain in force and ~ffect until the Funded Portion Completion Report is submitted, except as provided in E. below. At that date, all allocated grant funds which have not been expended or otherwise committed by contract, or are not reasonably expected to be paid out in connection with expenses incurred before that date, shall revert to and become a part of the Council's local government assistance fund, and may be reallocated or expended by the Council for planning assistance to other local governmental units in accordance with the Guidelines.
