Gamec <br />15153 Nowthen Boulevard, N.W. <br />Ramsey, MN 554303 <br /> <br />re: City of Anoka Landfill <br /> <br />Dear Mayor Gamec: <br /> <br />Thank you for your letter of October 28, 1980, regarding the Anoka Landfill. <br />Although none of the present members of the Anoka City Council were members of the <br />Council in 1976, the Council has reviewed the circumstances leading to the document of <br />October 25, 1976, and Minutes of Council Meetings whereat the document was <br />discussed. The Council has also reviewed pertinent Charter provisions and discussed the <br />matter with our City Attorney. <br /> <br />Our Charter prohibits the sale, lease, or other disposition of real property except by an <br />ordinance adopted by the affirmative vote of four-fifths of the Council In 1976 our <br />Charter prohibited the disposition of real property except by ordinance. The document <br />of October 25, 1976, was never adopted by ordinance. It was apparently approved only by <br />resolution at a special meeting on October 25, 1976. Other issues, such as sufficiency of <br />consideration have also been raised. <br /> <br /> We recognize that the landfill has raised difficult issues and provoked lengthy discussions <br /> in the past and Anoka remains open to further discussions on the subject. <br /> <br /> However, it is the position of the City of Anoka that it is not required to convey the <br /> landfiil to the City of Ramsey and that the appointment of a committee, if only for the <br /> purpose of discussing the transfer referred to in the document of October 25, 1976, would <br /> be inappropriate in view of the above. <br />~Yours ~uly, ,rx~ <br /> <br /> Riehard Blo.mquist <br /> Mayor <br /> <br /> <br />
