Specifically, <br />reference is made to your inquiry regarding reoccurring violations <br />and their prosecution. <br /> <br />Two items have appeared frequently on our inspection reports. These <br />are daily cover and litter. Most of these entries on the inspection <br />report were listed as "Discussion" items and not as an order for cor- <br />rection. The inspection report is a format for recording our obser- <br />vations, as well as for writing orders for correction of violations. <br />We have used a "Discussion" entry to record and rel'ate informational__ <br />items rto the site. operator. Such informational-items might include <br />areas needing additional effort, things that are coming due,~or to <br />point out areas which will be needing touch-up work in the near future. <br />Discussion_items are not conditions which would constitute a violation <br />subject to prosecution. <br /> <br />Waste Management of Minnesota was.prosecuted earlier this year for-.- <br />violations in 1979. There have not been, as yet, any prosecutions for <br />violations that occurred this year-- We will however, advise you when- <br />ever we place charges against the licensee.~ <br /> <br />If you have any questions, or if I may be of any service to you, please <br />call on me. <br /> <br />Robert M.
