pEHFOPA~ANCE CONTRACT <br /> wITH <br /> THE CITY OF RAUSEY <br /> <br /> THIS AGREEMENT, made and entered into the day of <br />1981 by and between the City of Ramsey, located in Anoka-0-6-~Y, State of <br />~innesota, hereinafter referred to as the "City", and Leisure Wood Ponds <br />Development Company, a partnership having its principal place of business <br />at 14542 Nowthen Blvd. N.W., Rs3nsey, ~nnesota, hereinafter referred to as <br />the ,,Developer". <br /> WHEREAS, the Developer has applied to the City Council for <br /> plat approval of the proposed plat known as Pondvale Estates; and <br /> ~%5{EREAS, the City Council has given approval to said prelimi- <br /> nary plat; and WP~EREAS, the Developer is required as a condition of plat <br /> approval of said plat to enter into a contract binding it to perform cer- <br /> tain acts and duties within a specified time as a contingency to the Council <br /> approving said plat; and <br /> WHEREkS, the City Council requires that said contingencies be <br /> performed in a timely manner, and guarantees for the performance of said <br /> contingencies must be given assuring the City of full performance within a <br /> certain specified period of time; and <br /> WHEREAS, the Developer hereby agrees to perform said contin- <br /> gent acts and duties in a timely manner; and <br /> WHEEEAS, the City Council has agreed to and does grant its <br /> approval to the Developer's plat known as Pondvale Estates contingent upon <br /> and conditioned upon the Developer's agreement to perform said acts and <br /> duties as are hereinafter set forth. <br /> NOW THEREFORE, IT IS HEREBY CoNVENANTEDANDAGREED, that the City Council <br /> grant its approval to Pondvale Estates plat conditioned upon and contingent <br /> upon the timely performance by the Developer of the following: <br /> l) That the Developer shall be responsible to meet certain <br /> City requirements for the total and complete installation in accordance <br /> with the following schedule of the improvements to the plat that are re- <br /> quired to be installed as plat improvements by and under the provisions of <br /> the City Code Chapter 170.03. That said requirements and improvements <br /> shall include but not be limited to: <br /> a) All in~provements sho_wnfn the construction plans <br /> for said plat entitled "~ Sewer, and Proposed Street <br /> Grades for Pondvale Estates" consisting of four (4) <br /> sheets prepared by HakansonAnderson Associates dated <br /> ~arch 12, 1980. <br /> <br /> <br />
