Excavation of the beds of public waters may be permitted except where; 1) it is <br />intended to gain access to navigable water depths when such access can be attained <br />by a dock: 2) inland excavation is intended solely to ~xtend riparian rights to <br />non-riparian lands, or to promote delvelopment of non-riparian lands; or 3) the <br />proposed excavation will be detrimental to fish or wildlife habitat or protected <br />vegetation. <br />The placement of structures in public waters is not permitted where the structure: <br />1) is intended to gain access to navigable water depths where such access can be <br />attained by other means; 2) will...obstruct navigation and/or create a water safety <br />hazard;or 3) will be detrimental to fish or wildlife habitat or protected vegeta- <br />tion (prohibited in posted fish spawning areas). <br /> The construction or reconstruction of dams, or changing the level of an existing <br /> control structure may be permitted to: 1) control flood waters; 2) maintain low <br /> flows; 3) manage water quality, including the prevention and/or control of erosion <br /> and sedimentation, 4) improve water based recreation; 5) create,improve, and main- <br /> tain water supplies; and 6) maintain aquatic habitat for fish and wildlife species. <br /> The crossing of public waters, including the construction of water intakes a_nd <br /> sewer outfalls, may be permitted when less detrimental alternatives are unavail- <br /> able or unreasonable, such crossings will not be premitted where the project will: <br /> 1) obstruct navigation or create a water safety hazard; 2) cuase or contribute to <br /> increases in flood elevations and damages; 3) involve channelization greater than <br /> channel realignments to improve hydralic entrance/exit conditions; and 4) be de- <br /> trimental to water quality, fish or wildlife habitat, or protected vegetation. <br /> <br />STATUS <br /> Currently Anoka County is in the process of reviewing the preliminary designations <br /> and mapping of the Cormnissioner which were received by the county on October 6, 1980. <br /> The county's 90 day review period expired on January 4, 1981. In resl~onse to the <br /> county's request for a one year extenslo , the Commissioner has granted the county <br /> an extension to June 1, 1981 (approximately a five month extension). <br /> Staff has reviewed the preliminary designations and mapping of the Commissioner of <br /> Natural Reseurces. In conducting this review, staff utilized information available <br /> from: 1/2 section aerial photos; soil maps; soil Conservation Service wetlands in- <br /> ventory; individual property owners; community officials, site investigations, county <br /> ditch records; and government lot surveys. As a result of the staff review a re- <br /> mapping has been undertaken. Before submission of the county's review and recommen- <br /> dations to the Department of Natural Resources, additional public informational meet- <br /> ings and review of staff recommendations and remapping by local units of government <br /> is deslrable. , <br /> <br />ISSUES <br /> The public waters/wetlands designation and mapping is, in some respects, a type of <br /> zoning. Said designation, will impact on lend use, effect property values, and impair <br /> the sale of properties. For this reason 'very accurate designation and mapping.is <br /> needed. The preliminary designation and mapping for Anoka County is very inaccurate, <br /> and thus totally unusable, because extensive areas have been included which do not <br /> qualify as ~ublic waters or wetlands. <br /> <br /> <br />
