Councilmember Woestehoff introduced the following resolution and moved for its adoption: RESOLUTION #22-192 RESOLUTION APPROVING A VACATION OF DRAINAGE AND UTILITY EASEMENTS IN RIVERSIDE WEST REARRANGEMENT RECITALS 1. The City of Ramsey received an application from Kinghorn Construction (the "Applicant"), requesting a vacation of a drainage and utility easements (the "Easement") on the property generally known as 6710 Highway 10 Northwest legally described as follows: Lots 1 & 3, Block 1, Riverside West Rearrangement (subject to easement as shown on plat), Anoka County, Minnesota (the "Subject Property") 2. That the plat of RIVERSIDE WEST created the Easement on May 24, 1976. 3. That the City Council reviewed and approved the plat of RIVERSIDE WEST REARRANGEMENT on June 14, 2022, and the Easement was not vacated at that time. 4. That the Applicant appeared before the City Council for a public hearing pursuant to Section 117-56 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City Charter on September 13, 2022, and that said public hearing was properly advertised and that the minutes of said public hearing are available. FINDINGS OF FACT 1. That the partial easement vacation will not violate the intent and purpose of the Comprehensive Plan. 2. That the easement vacation is necessary to accomplish the Applicant's intended purpose. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the Ramsey City Council hereby grants approval of a vacation of the Easement on the Subject Property, as shown on Exhibit 1.
