Councilmember Woestehoff introduced the following resolution and moved for its adoption: <br />RESOLUTION #22-192 <br />RESOLUTION APPROVING A VACATION OF DRAINAGE AND UTILITY <br />EASEMENTS IN RIVERSIDE WEST REARRANGEMENT <br />RECITALS <br />1. The City of Ramsey received an application from Kinghorn Construction (the <br />"Applicant"), requesting a vacation of a drainage and utility easements (the "Easement") <br />on the property generally known as 6710 Highway 10 Northwest legally described as <br />follows: <br />Lots 1 & 3, Block 1, Riverside West Rearrangement (subject to easement as shown on <br />plat), Anoka County, Minnesota <br />(the "Subject Property") <br />2. That the plat of RIVERSIDE WEST created the Easement on May 24, 1976. <br />3. That the City Council reviewed and approved the plat of RIVERSIDE WEST <br />REARRANGEMENT on June 14, 2022, and the Easement was not vacated at that time. <br />4. That the Applicant appeared before the City Council for a public hearing pursuant to <br />Section 117-56 (Easement Vacation) of the Ramsey City Code and Section 12.6 of the City <br />Charter on September 13, 2022, and that said public hearing was properly advertised and <br />that the minutes of said public hearing are available. <br />FINDINGS OF FACT <br />1. That the partial easement vacation will not violate the intent and purpose of the <br />Comprehensive Plan. <br />2. That the easement vacation is necessary to accomplish the Applicant's intended purpose. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants approval of a vacation of the Easement on <br />the Subject Property, as shown on Exhibit 1. <br />
