He stated that if there is a summary judgment in our favor, then the City would <br />hold all the cards. <br />Councilmember Strommen agreed that this information should be privileged and not out for all to <br />know. She stated that her fear is that the City will get to the end and lose the summary judgment <br />and will have no Plan B. She stated that it would be nice to have a Plan B, even if the City wins <br />and ends up going with Plan A. <br />Councilmember Dehen stated that he doesn't understand why the summary judgment is taking so <br />long, because the City should have filed this two months ago. He stated that it has never taken <br />him this long and he cannot believe that the word now is that there "may" be a decision by the end <br />of November. He stated that the City has not even filed or argued this yet. <br />Councilmember Elvig stated that he was hearing three different things: the summary judgment; <br />conceptualizing new land use and then putting it in front of the bank; and his idea of a potential <br />deal for the land. He stated that he feels now may be the time to "pull the trigger" and get all of <br />this off the table. He stated that he thinks the City has already spent significant time on this and is <br />afraid that more will be lost by just "tap dancing" and only doing steps 1-4. He stated that he is <br />nervous that the bank has figured out how to withstand and outlast the City. <br />Councilmember Strommen asked if he was suggesting that the City skip steps 1-4 or move forward <br />with all the steps. <br />Councilmember Elvig stated that he is thinking of moving forward with, perhaps, steps 1-5 because <br />he thinks the City needs to know what it has and what the market will bear and be smart about this. <br />He stated that he feels the City has about 3 months to cut a deal with the bank because the <br />gentleman who would like to buy a portion of the land for $2.5 million wants to be in the ground, <br />functioning by January or February of 2009. <br />Public Works Director Olson asked if he wanted to be constructing or functioning by early 2009. <br />Councilmember Elvig clarified that the gentleman wanted to be constructing by early 2009. He <br />stated that this is an opportunity and there isn't a lot of time to think about it. <br />Councilmember Strommen asked if Councilmember Elvig then wanted to look into the financing <br />possibilities first. <br />Councilmember Elvig stated that he did want to look at financing first because if the bank thinks <br />the City is willing to renegotiate, they will raise the price. He stated that he feels either way the <br />City is going to give up a lot of money for this, but he would rather have some control over the <br />situation and a place at the table in future discussions. <br />Councilmember Strommen asked if he was suggesting following a similar approach as Ramsey <br />Crossings to see where the City is sitting and if there are any possibilities. <br />Ramsey Town Center City Council Subcommittee Work Session / July 22, 2008 <br />Page 7 of 10 <br />
